I too seem to recall seeing in early NTIA (or other) documents
somewhere that ICANN was to be considered a regulator.

That was the basis on which the EU bought into the ICANN concept
in the first place.
Also there is clear precedent that ICANN has acted as a
'regulator' of the DNS market. e.g. structural separation, price
cap, conditions of Registrar competition, etc.
