Dear ALAC members, I have received one additional agenda item which the Board has asked to discuss, in addition to our agenda items: 1. Views on CWGs 2. Views on the new gTLDs Program and Objection Procedure Please be so kind to find the new question below: "What will be in your view the medium-term impact of the new gTLD program on the structure of ICANN in general, and challenges it brings to the gNSO, its constituencies and policy development process. 1. Entrance on more players: not all necessarily new but certainly with an increased stake in ICANN; Increased margin for criticism on balance of powers from external critics of the new gtld program and ICANN. 2. Strain on an already 'flawed' process: referring to balance of powers, Precedence set with exceptions: more requests for exceptions by a range of 'international' players requiring similar treatment as IRC and IOC; existing flawed systems and processes if not immediately addressed being applied to new entrants e.g RAA aspects being reviewed, flawed aspects of WHOIS and compliance monitoring 3. Test on tenuous trust that is being grown between internal stakeholder groupings Increased focus on internal processes by external critics of the new gtld program 4. More work all around for all constituencies with even less time to ensure process followed adequately and ineptly by all parts of the system - an existing problem. Early morning thoughts... Here's a first stab. ICANN in general: Just getting to this stage has demonstrated a number of problems, that largest being the difficulty of the various parts of ICANN to work cooperatively. Perhaps there has been ill-will (or at least benign neglect in nurturing cooperation) but now there is increasingly, a genuine will to work together. But how to do it is VERY problematic. It will certainly be possible, but there is a real possibility that processes which are already cumbersome and time-consuming may become even more so. (Look at the new improved comment period, which has dangerously decreased the amount of time for constituency consultation AND elongated the overall period). There is still a real danger of when other parts of ICANN disagree with you, deciding that they are simply wrong! GNSO: Within the GNSO, things may get interesting. A structure that allowed (to use crude words) three SGs plus NomCom appointees to gang up on one SG and adopt policy may not work when the two contracted SG get harder to tell apart (vertical integration). How the RySG will adapt to having perhaps hundreds of members instead of a handful may be a challenge. Overall, getting consensus within the GNSO is difficult now. The new changes may well push it past the point of being effective. WGs have shown problems now since they are easily overwhelmed by large numbers of participants who are financially motivated to participate. This is only likely to get worse.
