Rudi, I agree this law is a concern (just like ACTA)but I am not sure what the impact would be on the policy work in the ICANN context. can you enlighten us ? My perception of such laws is that at the end, the end-user, the internet consumer will need a lot of knowledge to understand what he/she is allowed to do. The reason such laws are written, voted and implemented is most often due to the bad guys. But in the internet world this means that every citizen is considered being a bad guy and has to prove the contrary. By implementing strict rules for registration of domain names, a better identity check, a closer monitoring and immediate action at registry-registrar level would avoid spending time, energy and a lot of taxpayers money to work out such laws. Being involved in the new on-line gambling law in Belgium, I see how much time it takes to elaborate an efficient workable law and related procedures to counter the problem of an ccTLD allowing anybody, whatsoever, without any identity check to book a domain name which afterwards is (mis)used by (very often) same criminal organisations. I know I'm knocking on difficult doors but if we only write laws that prohibit access, at the end, an open internet seems to be something very rare. I agree with the arguments and interpretations from Rudi. I think any restrictions of access or fundamental rights (by national laws or treaties like ACTA) will strengthen nothing but state control and paternalism and hamper consumer and civil rights of Internet users.
