Motion for the immediate dissolution of the ALAC Executive Committee
I share Evan's concern: Evan wrote: "It is necessary to request the entire ALAC to take responsibility for its creation. Personally I believe that this document illustrates an *inevitable* tendency for an ExCom to assume -- in the name of expediency -- power it was not authorized to take. As such, it may be justification for immediate dissolution of the Executive Committee." I join Evan and others in expressing my disgust at the situation and call upon the NARALO to consider this resolution: Whereas the ALAC's Executive Committee has forwarded an ALAC Statement prior to its ratification by member vote; Whereas the ALAC's Executive Committee has denied the at-large community a suitable public comment period for this Statement (giving us only two days to comment and no opportunity to propose amendments or changes); Whereas the Executive Committee has engaged in ex-parte non-transparent discussions pertaining to the ALAC agenda that deny members a process by which matters may be placed on the agenda; Whereas the ALAC Executive Committee seeks to usurp powers that it has not been granted; Resolved, the ALAC Executive Committee is to be immediately dissolved.

Danny, thanks for this, but would you to hold off taking your motion forward until the text for the ALAC Rules and Procedures describing the Executive Committee has been drafted and the community and ALAC has had time to consider it. I think this was what the ALAC agreed during our November call when passing the motions to acknowledge the Executive Committee's existence. Those two motions were: First: The ALAC create a 4-member Executive Committee composed of the four ALAC Officers. Until such time as a more refined specification be defined, the Executive Committee shall have no powers other than those explicitly granted by the ALAC, save that in urgent situations, the Executive Committee may make decisions on behalf of the ALAC, such decisions communicated to the ALAC prior to or at the time of decision, and to be ratified at the next ALAC meeting. and, Second: 1. The ALAC expand the Executive Committee to five people. The Executive Committee shall be composed of the four ALAC Officers and one additional ALAC member. 2. The ALAC redefine the two positions of Vice-Chair and the position of Rapporteur, and the associated voting processes to ensure that the Chair, the two Vice-Chairs, and the Rapporteur all represent different ICANN regions, the detailed Rules of Procedures to be approved prior to the 2009 Officer elections; 3. Following the election of the four officers, the ALAC shall nominate and elect an ALAC member from the as-yet un-represented ICANN region to the fifth Executive Committee position. I will ask the Executive Committee to draft text describing the role and structure of the Executive Committee reflecting the motions passed in November (hope they agree...) Given the problems the existence of the Executive Committee is already causing, this cannot wait for a complete redraft of the rules of procedure. It should be done now. I hope the new text will be available in good time so the community can consider the amendments and ALAC is able to vote on them at it's February meeting. I am not a member of NA Discuss so am not trying to send this note to <na-discuss@atlarge-lists.icann.org> Hope this is a reasonable way to proceed. Adam
