The Downside To UltraCheap Registrars
From Michele Neylon's blog:
"Some domain registrars only USP (unique selling point) is price. I've mentioned the issues with DirectI's pricing structures in the past. With the price increase this week I was more or less expecting there to be some kind of backlash, but I wasn't expecting this: All the Pending gTLD Transfer Orders (i.e. orders that haven't yet been executed) throughout your Reseller Chain will be canceled by the system on 12th October, 2007. These orders can be placed again by you / your Customers from 13th October onwards. Also, the Transfer Orders that are currently in status 'Awaiting Admin Contact approval' will also be canceled by the system. These again, can be placed by you / your Customers from 13th October onwards. Domain transfers can be painful enough in the best of circumstances (clients providing incorrect EPP keys, ignoring emails etc., etc.) but this is a bad joke! DirectI's pricing strategy was going to cause issues, but this might be the beginning of the end for some of their resellers. This kind of mess will cost a lot of people money and business." http://www.isquattedyour.eu/2007/10/11/the-downside-to-ultracheap-registrars... hmmm... perhaps the ALAC can propose a solution and post it to raa-consultation[at]icann.org unless of course, they enjoy the status quo... __________________________________________________ Do You Yahoo!? Danny Can you clarify on this - because a price increase was implemented, they CANCELLED everything that was submitted and pending but not yet gone through and people have to start all over again, instead of just applying the increased price? Did they notify people individually of these cancellations or will they only know if they check? Jacqueline, Michele Neylon's note concerned transfer transactions on October 12th, the same day that Directi's Reseller Club implemented it's price increases: see their announcement at http://www.resellerclub.com/news/resellerclub_announces_new_gtld_pricing/200... It looks like they wanted to ensure that every transfer processed through their system was at the higher price, even if it had been requested prior to the date of the scheduled price increase. It looks like Michele got one of the notices sent to the resellers (who must now figure out how to best deal with the situation). Doubtless we can ask Directi CEO Bhavin about his policy choice in LA... but in the meantime, his policy doesn't comply with the allowable reasons to deny a transfer request: The Registrar of Record may deny a transfer request only in the following specific instances: --Evidence of fraud --UDRP action --Court order by a court of competent jurisdiction --Reasonable dispute over the identity of the Registered Name Holder or Administrative Contact --No payment for previous registration period (including credit card charge-backs) if the domain name is past its expiration date or for previous or current registration periods if the domain name has not yet expired. In all such cases, however, the domain name must be put into "Registrar Hold" status by the Registrar of Record prior to the denial of transfer. --Express written objection to the transfer from the Transfer Contact. (e.g. - email, fax, paper document or other processes by which the Transfer Contact has expressly and voluntarily objected through opt-in means) --A domain name was already in lock status provided that the Registrar provides a readily accessible and reasonable means for the Registered Name Holder to remove the lock status. --A domain name is in the first 60 days of an initial registration period. --A domain name is within 60 days (or a lesser period to be determined) after being transferred (apart from being transferred back to the original Registrar in cases where both Registrars so agree and/or where a decision in the dispute resolution process so directs). Here is a case where a complaint should be filed with ICANN's Compliance department (but there isn't a defined procedure to do so...), and situations like this really call out for sanctions to be applied (but no one has defined a sanctions programs for registrars with set penalties for violations). The notion of having to resubmit a transfer request just because a registrar wants to raise his prices is ludicrous. --- "Jacqueline A. Morris" <jam@jacquelinemorris.com> wrote:
