Dear Joke,

Please refer this matter/email to Council, as I can not post directly to
the Council List, and this is directed really towards Council, rather
than you.

As I have previously discussed with you one seconder (Mr Immossi from
.GI) has seconded two candidates.

You have then responded that only the first first secondment can be
taken into consideration, and the second one cannot.

This decision violates the idea that someone may change their mind, and
I can also not find any rule permitting this decision.

I would be very uncomfortable, in principle, if this decision were to
have been taken by the election manager, ie ICANN Staff.


While I am in dispute with the Chair of Council about the rules of the
ccNSO (and what she terms "guidelines" and/or "procedures" for which I
can find no provision in the Rules or Bylaws, making none of them
binding on ccNSO Members)

   Guideline: ccNSO Nominations process ICANN Board seats 11 and 12,
   Version 3

states in

  3.4 Call for Candidates
  [...]
  Each ccNSO member can nominate one person for a seat to be filled on
  the ICANN Board and each member can second one person.
  [...]

It does *not* state,

  Each ccNSO member can nominate one person for a seat to be filled on
  the ICANN Board and each member can second one person, any subsequent
  nomination or secondment is invalid.


I therefor formally challenge the nomination of Mr Phair, who I can not
recall ever having seen or heard of, by the way.

I know that the Council nominates a/the candidate to the chair, but as I
wrote above, none of any "guidelines" or "procedures" conform to the
Rules as per the bylaws, and I am starting to find myself in agreement
with Bill Semich, that most of what Council has done over the last years
is in violation of the Bylaws.

That said, I also agree with him that we should not re-litigate the
past, but do it right from now on.
