Subject: [Ext] CCWG-Accountability WS2 report

 

Dear Katrina,

 

As requested for the benefit of the ccNSO Council, please find below a report on the progress of the CCWG-Accountability WS2.

 

Since Hyderabad, CCWG-Accountability WS2 activity has made progress on several key items. The Rules of Procedure of the Independent Review Process are up for public comment until January 25th. Given the importance of the IRP, will the ccNSO council submit a response ?

 

Public input will also shortly be sought on :

- the Draft Human Rights Framework of Interpretation.

- a fact finding questionnaire related to the hotly debated issue of Jurisdiction. There are strong positions against and in favor or ICANN’s legal incorporation in the State of California, USA that has caused debate in the legal and political implications of the geographic location.

 

Draft recommendations of 2 other subgroups (Transparency, Guidelines for good faith in the process of Board director removal) are under review by the plenary.

 

CCWG-Accountability should be able to report on these topics, and engage the ccTLD community, by Copenhagen.

 

The ccNSO contribution to the SO/AC accountability questionnaire has been received, and very much appreciated. Analysis of the various contributions is in progress, as the last submissions are being received.

 

Overall this progress (summarized monthly in a Dashboard available here : https://community.icann.org/display/WEIA/WS2+Dashboard[community.icann.org]) remains behind schedule. It is becoming increasingly unlikely that the work be completed by ICANN 59 as initially contemplated. A discussion on a more realistic timeline is under way and an update will be provided in Copenhagen.

 

Meanwhile, expenses remain largely below budget, with very little Legal advice being requested for the moment.
