Subject: FOR YOUR REVIEW & COMMENTS: Requirements for external expert to advise Community Representatives Group on establishing the IRP Standing Panel

 

Dear community leaders, 

 

I’m writing to provide you with a brief update on progress as regards the establishment of an Independent Review Process (IRP) Standing Panel. We understand that the remaining SOAC groups who intend to send appointees to the Community Representatives Group are either completing, or will shortly complete, their internal processes to do so. Thank you all for your cooperation in making sure we will be able to commence the group’s work in a timely manner.

 

In addition, during our last call, ICANN org took an action to draft a Statement of Work (SOW) for the engagement of an external expert consultant.  Please find attached for your consideration a draft SOW and a requirements document, outlining respectively the scope of work that we see the expert being asked to do and the required skills/qualifications that we believe are needed to do the work. We would like to know if you agree with the work scope and the required skills, and if there are any other factors that you would like to see added. We will greatly appreciate your feedback at your earliest convenience, and if possible by 8 February 2021. 

 

We are also compiling a list of potential experts that may meet the criteria identified, including experts that ICANN has not previously worked with. If you have any suggestions of experts that meet the skillsets identified, please let us know.  We will conduct the engagement in accordance with ICANN’s Procurement Policy and will work with the Community Representatives Group, as appropriate, on the final selection, with a goal to have an expert contracted as quickly as possible after the Community Representatives Group has been finally comprised.

Subject: Update on formation of the Community Representatives Group to nominate the IRP Standing Panel

 

Dear community leaders,

 

As of the 4 December closing date of the Call for Expressions of Interest to serve on the Community Representatives Group for selecting the IRP Standing Panel, ICANN org received a total of six (6) applications. The following Supporting Organizations and Advisory Committees each saw at least one (1) applicant seeking its endorsement: ALAC, GAC, ccNSO and GNSO. This means that no applications for endorsement were received for the ASO, RSSAC or SSAC.

 

Unless you have any concerns with these numbers, we will proceed to provide the leadership of each of the four named SOACs (ALAC, GAC, ccNSO, GNSO) with the relevant candidate(s)’ application materials. As it remains important to finalize the appointment of the IRP Standing Panel as soon as is feasible, ICANN org would like to suggest that each of these four SOACs confirm, by Friday 29 January 2021, whether the applicant(s) who have sought that group’s endorsement will represent it in the Community Representatives Group.

 

In the meantime, ICANN org is finalizing the process and requirements for appointing the external consultant who will assist the Community Representatives Group with its work, which we hope to complete by the same date. Once we receive all necessary confirmations about the Group’s membership, we expect to be able to convene the Group to begin its work in accordance with the community-agreed Terms of Reference (circulated previously).

Thank you for following up! This topic was actually on our radar for touching base with you all this week, as we have not received any additional feedback to the suggestions below. As it is now early November,  here are our updated suggestions:

 

Please let me know as soon as possible if you disagree with this proposed process for collecting and distributing the Expressions of Interest received.

 

(1) Does your SO or AC intend to participate in the Community Representatives Group;

(2) if so, do you plan to send 1, 2 or more member(s);

(3) Confirm your approval of the current ToR; and

(4) Confirm how much time your group will need to finalize its appointment of member(s).

(Note: Our assumption is that structures with distinct constituent groups, e.g. At Large and GNSO, will have conferred internally by the 20 November date as to the process they will be following for this purpose.)

Yes, what Manal has summarized is what we are suggesting, so if you have no objections and concerns we will proceed to draft a call for Expressions of Interest to join the Community Representatives Group, making it clear that an applicant will have to indicate the SO, AC, SG or Constituency group they intend to represent and which will determine the SO/AC towards which that application will be directed. The call will also clarify that the selections will be done by each SO/AC in accordance with its own internal agreed processes. As noted below, we can aim to open the call by the end of this week, with applications to be received no later than 13 November.

 

In the meantime, we will be very grateful if each SO and AC chair (after consulting with your members, regional groups, stakeholder groups or constituencies, where applicable and appropriate) can respond by the suggested 16 November date with regard to the specific points about your selections plans.

 

Finally, as a few community groups are transitioning to new leadership teams, I have taken the liberty of adding the new GNSO Council leadership team as well as the incoming chairs of the RySG, NCSG and NPOC to this list (while keeping, for the moment, the outgoing chairs to ensure continuity).

If I understand correctly, we will be working in parallel to do both, approve the ToR and trigger the relevant processes within each SO/AC, but will not finalize the group representation until the ToR is approved ..

Thanks very much for raising this question as it will allow me to clarify points that I should have highlighted in my previous message!

 

As you noted, the current proposal is for those Supporting Organizations and Advisory Committees (SOACs) who plan to participate in the Community Representatives Group to also approve the final Terms of Reference (ToR) by consensus. Our suggestion to proceed with issuing a Call for Expressions of Interest at this time is not meant to change or affect that consensus approval process.

 

The reason we suggested going ahead with the Call is because we understand that it may take time for some participating SOACs to decide on their member(s) for the Community Representatives Group. Since this leadership group has discussed the composition, aggregate skillset and overall size of the Community Representatives and there is evident support for these various items, we thought it made sense to open the Call while you and your groups do a final review of the ToR. In other words, for the Call we are only going to be relying on what is encapsulated in Section 3.1 of the current ToR.

 

As such, perhaps we can aim to issue the Call for Expressions of Interest by mid-next week; to close approximately two weeks following its publication (e.g. 13 November). We will be happy to collect all applications and send the relevant ones to you for your group’s consideration in accordance with the group’s internal processes.

 

In addition, I will take the liberty here of suggesting that (following consultations with any constituent groups, as applicable – e.g. for the ALAC Chair with the RALOs and the GNSO Stakeholder Groups and Constituencies with the GNSO Chair) each SOAC Chair should reply to this email thread by 16 November as to whether:

(1) your SO or AC intends to participate in the Community Representatives Group;

(2) if so, whether you plan to send 1, 2 or more member(s);

(3) confirming your approval of the current ToR; and

(4) stating how much time your group will need to finalize its appointment of member(s).

 

I hope that is clear and thank you all again for continuing to work with ICANN org to complete the important Bylaws task of appointing the IRP Standing Panel.

On sharing and discussing with the GAC leadership, cc’d to this email, there was a concern that this “seems to take for granted that the updated ToR now are considered adopted and the process for EoI etc. can be launched…” .. Doesn’t this

“require SOAC approval as chartering organizations (as the ToR themselves state in 2.4)…?”

I apologize for adding to the number of emails you are no doubt receiving as we move into the ICANN69 Community Week. However, we thought you would prefer to receive this update sooner rather than later, so that you can inform your respective groups and factor in the need to initiate your internal processes to select members for the Community Representatives Group into your overall planning and current activities.

 

Please therefore find attached the updated, proposed Terms of Reference (ToR) that will guide the work of the Community Representatives Group to select a slate of nominees for the Independent Review Process (IRP) Standing Panel. We have included the additional criteria suggested by Donna as well as cleaned up the document to reflect previous feedback from various groups. As the first action will involve constituting the Community Representatives Group, I will also highlight the fact that we have noted your collective preference that the Group be kept small, comprise an odd number (at least 7, but not more than 15, members), be as diverse as is feasible, and possess certain skillsets in the aggregate. The updated ToR also notes that the Group will seek to act by consensus, select its own Chair, and maintain confidentiality of its deliberations while maintaining as much transparency as is practicable (e.g. publication of the final ToR, the Group members’ Statements of Interest and other relevant documents).
