Board Seat 11 Nomination Process:on-line adoption Nomination report and Nomination by the ccNSOCouncil of Patricio Poblete.

 

1. Adoption Nominationreport

Background

At its meeting on22 August  2019 the ccNSO Council appointed Joke Braeken asNomination Manager and adopted the Nomination proceduretimeline.

In accordance withthe adopted timeline, the Nomination Manger submitted theNomination Report on 10 February 2020. In the Nomination Reportseveral issues were identified and observations made. None of theidentified issues had a material impact on the process. However,the Nomination Manager recommended to resolve these issues tofurther enhance transparency and predictability of the process. Inshort, the issues andobservation identified are:

  • Issues:
    1. The due diligence verifications lasted well over 2months.
    2. Unclear definition of the milestones in thetimeline.
    3. The Guideline does not define if a (new) membermay vote if ccTLD Manager became member after closing of call fornomination  and before election procedure.
    4. Placeholders in the Guideline
  • Observations
  1. Despite various efforts toreach out to ccNSO members, there are still ccNSO members withoutdated contact details
  2. The due dilligence verificationand the Q&A with the candidates were conducted in parallel, asa transitional arrangement.
  3. One candidate rectified hiselection statement to address  a mistake in the originalcandidate statement
  4. One member of the ccNSOrepeatedly  (3 times) expressed concerns about the validity ofthe Guideline and actions taken under the Guideline. The ccNSOCouncil discussed the matters raised at its Council meeting andconcluded it did not see a reason to revoke or change thenomination process.
  5. The orginal timeline for theelections was amended by the Nomination Manger. The matter was discussed by the ccNSO Council andthe ccNSO Council subsequently adopted an online resolution, confirming the adjusted timeline of the ccNSO memberselection process in the ICANN Board Seat 11 nominationprocedure.
  6. The concern raised that ballots wouldbe accepted ahead of the official vote start of process was notvalid.

 

Decision

The ccNSO adoptsthe Nomination Report, including the recommendation to resolve theissues identified by the Nomination Manager, and request the GRC topropose an update of the Guideline: ccNSO Nominations process Boardseats 11 and 12 (22 August 2019) to address Issues i – iiiidentified by the Nomination Manager accordingly and prior to theanticipated upcoming Nomination Process. The ccNSO Council notesthat issue iv identified is being addressed as part of the ongoingGRC work with respect to role of the ccNSO as DecisionalParticipant. 

The Councilnotes and concurs with the observations of the Nomination Manager.

 

The ccNSOCouncil thanks Joke Braeken as Nomination Manager and her hard workduring that time.

 

2 Nomination PatricioPoblete

DraftResolution

Background

ICANN Board Seat 11 becomes vacant at the end ofthe ICANN Annual General meeting in 2020. The timeline of thelaunch of the nomination period. was approved by the ccNSO Councilon 22 August 2019. In accordance with the approved timeline, thenomination period closed on 2 October 2019 at 23:59 UTC and thefollwing candidates were nominated and seconded (in alphabeticalorder):

  • CalvinBrown
  • Nigel WilliamPhair
  • PatricioPoblete

No issues emergedfrom the due diligence background verification.

 

The election periodopened on 15 January 2020 (00.01 UTC) and closed  31 January2020 (23.59 UTC). During this period, out of 172 members of the ccNSO, 109 members (63%) castedtheir votes and:

  • CalvinBrowne received 42 votes (39% of votescast);
  • NigelPhair received 8 votes (7 % of votescast);
  • PatricioPoblete received 57 votes (52 % of votescast);
  • 2 members selected the option“none of the above” ( 2% of votes cast).

The ccNSO Counciladopted the Nomination Report, including the recommendations toresolve the issues identified by the NominationManager.

 

 

Decision

The ccNSOCouncil nominates Patricio Poblete to be designated by theEmpowered Community Administration to fill ICANN Board Seat number 11 starting atthe end of ICANN's Annual General Meeting in 2020 for a term ofthree years.

 

The ccNSOCouncil request the Chair to inform the Empowered CommunityAdministration, ICANN Secretary, and Chair of the ICANN Board ofthe nomination of Patricio as soon as this resolution becomeseffective at which time the Nomination Process is formally closedas well.

 

The Councilcongratulates Patricio and wholeheartedly and thanks Calvin Brownand Nigel William Phair for standing ascandidate.
