As you may remember, one of the action items from our Council meeting in October was to prepare a call for volunteers for the Community Representative group (CG). I re-read Mary’s email more carefully and realised that they propose that ICANN org would issue a “nation-wide” call, collect all applications and then forward to us those who seek endorsement from the ccNSO. It means that we do not need to worry about the call but rather concentrate on the procedure. Unfortunately, the GRC is still working on a general selection guideline, therefore we might need something specific for this case. Please find attached a proposed interim procedure.

 

The current plan as proposed by ICANN Org is:

  • Open a call for Expressions of Interest by this Friday, 13 November, closing Wednesday 25 November.
    • We had conceived this to be a single call, to be published in the Community Leadership Digest and circulated to/by each SO, AC, Stakeholder Group and Constituency to its members, with all responses coordinated and collated by ICANN org.
    • Each SO and AC chair will then receive a list of names and application packets from those respondents who had indicated they wished to be considered for selection by that SO or AC (note: for the GNSO, the same information will be sent to the GNSO Chair and the chairs of all the GNSO Stakeholder Groups and Constituencies to facilitate their discussion about the selection process).

Please let me know as soon as possible if you disagree with this proposed process for collecting and distributing the Expressions of Interest received.

 

  • Set Friday 20 November as the deadline for all SOAC responses to the questions posed previously (reproduced here for your convenience):

(1) Does your SO or AC intend to participate in the Community Representatives Group;

(2) if so, do you plan to send 1, 2 or more member(s);

(3) Confirm your approval of the current ToR; and

(4) Confirm how much time your group will need to finalize its appointment of member(s).

(Note: Our assumption is that structures with distinct constituent groups, e.g. At Large and GNSO, will have conferred internally by the 20 November date as to the process they will be following for this purpose.)

 

We will need to address the questions below at our upcoming Council call.

Dear community leaders,

 

I apologize for adding to the number of emails you are no doubt receiving as we move into the ICANN69 Community Week. However, we thought you would prefer to receive this update sooner rather than later, so that you can inform your respective groups and factor in the need to initiate your internal processes to select members for the Community Representatives Group into your overall planning and current activities.

 

Please therefore find attached the updated, proposed Terms of Reference (ToR) that will guide the work of the Community Representatives Group to select a slate of nominees for the Independent Review Process (IRP) Standing Panel. We have included the additional criteria suggested by Donna as well as cleaned up the document to reflect previous feedback from various groups. As the first action will involve constituting the Community Representatives Group, I will also highlight the fact that we have noted your collective preference that the Group be kept small, comprise an odd number (at least 7, but not more than 15, members), be as diverse as is feasible, and possess certain skillsets in the aggregate. The updated ToR also notes that the Group will seek to act by consensus, select its own Chair, and maintain confidentiality of its deliberations while maintaining as much transparency as is practicable (e.g. publication of the final ToR, the Group members’ Statements of Interest and other relevant documents).  

 

Assuming that the updated ToR reflects your understanding of the agreements reached and general expectations of the role and tasks for the Group, we suggest issuing a call for Expressions of Interest for potential Group members soon. I will be happy to assist with drafting that call, and if appropriate can send you a draft for your approval before ICANN69 concludes.

(2) experience working with recruitment firms and managing vendors;

(3) relevant organizational and process experience (i.e. ability to understand and evaluate the standing panelist criteria and responses, which includes legal and arbitration experience) and

(4) understanding of the Independent Review Process and its role as an ICANN accountability mechanism/relationship to ICANN bylaws (something like that)

(5) ability to work in a small team across multiple timezones

(6) must be able to commit considerable time and effort to the selection process over a short but concentrated time period

Thank you for your time and input during the calls and regarding the draft Terms of Reference circulated previously, concerning the formation of a Community Representatives Group to select a slate of nominees for the IRP Standing Panel. Please find attached the following for your further consideration:

 

  1. Updated draft Terms of Reference, incorporating input received to date (most recently from the GAC) as well as two comments from ICANN org on the GAC’s questions about the role of the Empowered Community and document disclosure – basically:

·        while the EC may be a Claimant in an IRP, the formation and selection of the Standing Panel is not an EC action; and

·        requests for document disclosure will be handled in accordance with ICANN org’s Documentary Information Disclosure Policy (DIDP).

  1. Notes from the 2 September call where the composition and criteria for appointment to the Community Representatives Group as well as a possible timeline were discussed.
  2. The list of criteria and requirements for IRP panelists that were published along with the call for Expressions of Interest.

For community leaders:

  • Please review and provide comments on:
    • The proposal that emerged on the call, as regards the Community Representatives Group (viz. “The Community Representatives Group should be a small, lightweight, odd-numbered group of between 7-15 members, who [in the aggregate] have [the following agreed] expertise and who, as far as possible, represents a diversity of stakeholders and interests across the ICANN community. The size of the group is less important than the skillsets/expertise of the members on the group”; and

  • If your group wishes to provide input or additional comments on the draft Terms of Reference, we will be grateful if you are able to do so by 18 September if at all possible.

 

For ICANN org:

  • Following receipt of additional input on the updated Terms of Reference (if any), we will prepare and circulate a consolidated and updated document and timeline.
  • Once a draft Statement of Work (SOW) is available as regards appointment of the external expert, we will circulate the draft SOW to this group as well.
