On Private Resolution of Contention Sets (including Private Auctions)
Instead of entirely banning private resolutions, certain prohibitions could be included in the Applicant Guidebook, Terms and Conditions, and in the Registry Agreement to the effect that participation in a private resolution (including private auction) where applicants obtain financial benefit from withdrawing their applications would result in a cancellation of the application (if discovered during the application process) or forfeiture of the TLD (if discovered after the TLD is awarded).
Further, the suggested mechanism of raising application fees to discourage speculative applications is unsound as a higher application fee would have a negative impact on the ability of certain legitimate applicants to apply for TLDs.
