Motion – DNS Abuse PDP1 Charter

WHEREAS:

On 4 August 2025, the GNSO Council passed a
motion to request an Issue Report on DNS Abuse Mitigation;

On 8 September 2025, the Preliminary Issue Report on a Policy Development Process (PDP) for a PDP on DNS Abuse Mitigation was published for
Public Comment and received twenty-seven (27) submissions;

On 01 December 2025, the
Final Issue Report on a PDP for DNS Abuse Mitigation was delivered to the GNSO Council, which accounted for the Public Comment review process summarized through a
Public Comment Summary Report;

On 11 December 2025, the Final Issue Report was presented during the GNSO Council meeting and the GNSO Council
initiated the PDP for DNS Abuse Mitigation PDP1; with Councilors suggesting amendments to the draft charter;

On 12 December, a Charter Drafting Team for DNS Abuse Mitigation PDP1 was formed;

On 5 January 2025, the final draft of the
PDP WG charter was submitted to the GNSO Council, including the following amendments: 1) update to the Charter Questions; 2) Updated the language on Human Rights considerations 3) adjusting the membership structure to
make it a "Representative Model"; 4) updated the seat allocation of the WG Model, including Participant members.
RESOLVED:

The GNSO Council adopts the
PDP WG charter for DNS Abuse Mitigation PDP1 and requests that the PDP WG be convened as soon as possible.

The GNSO Council requests that the GNSO Secretariat publish the Call for Volunteers for Members, Participants, Alternates, Observers, and relevant liaisons per the membership structure within the
PDP WG charter.

Motion - IRT on IGO-INGO Curative Rights

On 27 March 2025, the IGO-INGO Curative Rights Implementation Review Team (IRT) was convened to provide guidance to ICANN org on the implementation of the final recommendations adopted by the ICANN
Board from the Expedited Policy Development Process (EPDP) on Specific Curative Rights Protections for International Governmental Organizations (IGOs) and the Policy Development Process (PDP) on IGO-INGO Access to Curative Rights Protection Mechanisms;

On
3 December 2025, the IRT discussed the implementation approach for creating an arbitral process for cases involving IGOs; specifically, the timeframe within which the parties to a dispute under the Uniform Dispute Resolution
Policy (UDRP) or the Uniform Rapid Suspension procedure (URS) may initiate the new arbitral proceeding set out in Recommendations 3 and 4 of the EPDP
Final Report;

The IRT specifically discussed the scope of Recommendations 3 and 4 of the EPDP
Final Report, which reference the use of the new recommended arbitral proceeding only after a determination of the UDRP or URS dispute or a decision issued by a court in a related dispute;

IRT members and ICANN org staff agreed that one of the policy objectives of the Final Report is to allow parties to a UDRP or URS dispute to voluntarily leverage alternative dispute resolution
processes;

Accordingly, the implementation of the EPDP recommendations should permit initiation of the new arbitral proceeding at any time after the UDRP or URS complaint is filed by an IGO Complainant, including
before a determination is made;

On [19 December 2025], Damon Ashcraft, the GNSO Council Liaison to the IRT, notified the GNSO Council of the IRT’s discussions and requested that the GNSO Council confirm that the implementation
approach proposed by IRT members is consistent with the adopted policy recommendations;

The Council has now considered the IRT’s request.

The GNSO Council confirms that the intent of the EPDP policy recommendations was to enable the respondent to a UDRP or URS dispute to voluntarily leverage alternative dispute resolution mechanisms
at any time once the UDRP or URS proceeding has been initiated, and the policy recommendations enabling the new arbitral proceeding should not be read to limit that ability.

The GNSO Council requests that its liaison to the IGO-INGO Curative Rights IRT provide this information to the implementation staff and IRT.
