i would like to lend my voice to Susan's request for an amendment to the resolves clauses or a postponement of the whole motion.

@Susan, many thanks for raising the point about the concerns around staff updating the PSR and council taking a vote without further discussion on alternatives to this route. The BC shares similar concerns with the IPC and trust that the council will find an amicable path forward.

Thank you for circulating the draft Motion proposing a further deferral of Phase 2 of the RPMs PDP, together with a request to staff to update the Policy Status Report (PSR).  We appreciate that the PSR was prepared a couple of years ago, and so it seems timely to consider updating this.  The IPC does have some significant reservations about the previous PSR, however, such as that the manner of presentation of some of the data was rather misleading or indeed, in some cases, incorrect.  If the PSR were to be updated, we would want to be assured that this feedback was addressed, absent which we do not support the effort.  In the circumstances, therefore, while we are in favour of deferring Phase 2, as proposed, we are not in favour of requesting that staff update the PSR, without further discussion. 

 

We would like to request that the motion be amended to remove the references to the PSR, by deleting resolved clauses 3 and 4, and amending 5 to remove the words after "deferral".  This would allow the vote on the deferral of Phase 2 to proceed, while the matter of the PSR could then be handled as a discussion item.  Is this something you would be willing to consider as a friendly amendment Greg? As an alternative, we would also accept postponing a vote on the whole motion in order to allow this to proceed as a discussion item at the October meeting before being brought back for a vote (as appropriate) in November, if that would be acceptable instead?

The attached motion proposes deferring next steps on the RPMs PDP Phase two (UDRP Review) for a further 6 months and requesting an updated Policy Status Report (PSR). The rationale for the deferral is below, however, this is just a proposal. Please discuss with your SGs. We can move this topic to a Discussion Item at October's meeting if Councilors feel more dialogue is warranted.

 

Rationale:

 

The implementation of RPMs Phase One is estimated to be delayed from December 2024 to third quarter 2025 and, consequently, we recommend deferring next steps on the RPMs PDP Phase two UDRP Review) for a further 6 months while also requesting an updated Policy Status Report (PSR).

 

As you may recall, the Council previously discussed the need to review the RPMs charter in advance of launching Phase Two of the PDP. The Council determined that a PSR should be requested from ICANN org, in order to better understand if new issues or information has emerged that would be relevant to a comprehensive review of the policy. ICANN org's Global Domains and Strategy (GDS) team completed the PSR [gnso.icann.org] and shared it with the Council for discussion during the July 2022 meeting. Discussions in subsequent meetings seemed to indicate support from the Council to delay next steps based on a number of reasons, but primarily because of the amount of competing work. The Council agreed during its November 2022 meeting that because of the launch of the Phase One RPMs Implementation Review Team (IRT), which would likely have overlapping community support with a Phase Two PDP, the delay for next steps should be tied to the completion or key milestones for the IRT.

 

During its meeting on 16 February 2023, the GNSO Council agreed to defer next steps on the RPMs PDP Phase Two for 18 months and to provide a rationale for its decision. Accordingly, the reasons for the deferral are that the IRT will occupy the same people and staff as Phase Two, and the IRT is expected to take about 18 months to complete its work. Thus, to avoid overloading community and staff resources, the Council agreed that it is preferable to pause Phase Two until the IRT has concluded its work. The Council also emphasized that this timeframe is consistent with that which it had suggested in its previous discussions, and that the 18-month deferral could always be revisited if the IRT were to take more, or less, time to complete.

 

In September 2024, GNSO Council support staff advised Council leadership of an estimated delay of the implementation of RPMs Phase One from December 2024 to third quarter 2025. Consequently, leadership requests Council approve a further deferral of 6 months as the reasons for the original 18-month deferral still apply. However, since considerable time has passed since the last Policy Status Report was published in July 2022, the GNSO Council is also requesting an updated PSR, so that when the deferral concludes, the Council will have updated resources to properly determine the appropriate next steps.

 

This motion for deferral will be added to the consent agenda for the GNSO Council meeting on 17 October 2024. Approval of the accompanying motion to defer will start the 6-month period from 17 October.  In accordance with standard procedure, this motion is hereby submitted by Council leadership to the GNSO Council list by Monday, 07 October 2024, the document and motion deadline.
