Taking a closer look, it appears that Item 3 entails the element of approval of the Recommendation by the Chartering Organizations.  However, it isn't quite clear how an entity or individual that wanted to file for RFR or IRP would know how to rule out certain types of decisions or omissions as not susceptible to the Accountability Mechanisms if the language remains general (as opposed to being limited to the Auction Proceeds CCWG Recommendation specifically.)

Thanks Paul.  I think Item 1 as listed would have to say that the CCWG Recommendation in question is actually approved by all the Chartering Organizations for the CCWG, not just "a recommendation from the CCWG"

I am not commenting on 2 or 3 (or the general approach taken here) at this stage since I have not had time to consider those.

Dear Councilors,

Please note the proposed bylaw update to “Limit Access to Accountability Mechanisms” below. I think this directly relates to our ongoing conversation about Board Resolutions 2023.10.26.11 and 2023.10.26.12 at ICANN 78 (see our most recent letter on this subject here: https://gnso.icann.org/sites/default/files/policy/2024/correspondence/dibiase-to-sinha-09jan24-en.pdf ).  We can discuss further at our Council Working Session on Sunday.

Thanks,

Greg

Community Consultation On Timing and Potential Deferral of ATRT4 Review

ICANN org is initiating consultation with the community to seek input on the timing of the Fourth Accountability and Transparency Review (ATRT4) and whether there is a need for a deferral of the ATRT4 for a limited time. A consultation approach is being used because it will allow for a targeted conversation with the SO/AC Chairs and their constituencies. While ATRT4 is of general interest to the entire ICANN community, it is important for the Board and org to understand whether the SO/ACs would be available to come together to populate, perform and deliver the recommendations within the ATRT4 while carrying out their other work.

Members of the ICANN org Review Support and Accountability team are available to meet with interested community groups during ICANN79 or after to address questions about ATRT4 Timing and other Review Topics.

To schedule a meeting to discuss, please contact: rsa-coordinators@icann.org

Community consultation and engagement activities leading up to and during ICANN79 include:

- ICANN79 Prep Week Webinar (Thursday, 22 February)

- ICANN79 Community Session on ATRT4 Deferral and Pilot Holistic Review (Tuesday, 5

 March)

- ICANN79 briefings (at the request of your community group)
