The UDRP is an example of a Consensus Policy that takes into account the Registration AND USE of a domain name and falls within the picket fence.  Another example is the Registration Restrictions Dispute Resolution Policy (RRDRP) that some registries with restrictions use.

 

So although regulating content is not within ICANN’s mission, there are certain dispute policies that take content into consideration.

To Leadership and Staff: As a new Councilor, I have a couple of specific questions regarding these materials and the SPS agenda;

 

  1. Given that a prioritization exercise has occurred and that the ICANN Board has authorized additional funds (about $5M I think) for addressing 45 priority projects and given that addressing priority work and getting it moved along was an emphasis in the 2021 SPS meeting, does the agenda for the upcoming SPS meeting in December include time to review the priority project list and discuss GNSO Council role in moving that list along?

 

  1. Regarding the “Picket Fence” slides, one illustration of “What’s Inside” includes the following phrase: (v) dispute resolution policies that take into account the use of a domain name

 

 

However, the post-transition ByLaws amendments Annex summary states the following and I am trying to understand the meaning of these two phrases in conjunction with one another.

the use of such domain names);
