Sorry all but I am not finding the link or a Word doc for the draft responses to Sub Pro ODP Question Set 6 anywhere in my inbox – could be a glitch in our system. I clicked on the link Marika kindly provided
in the chat in today’s webinar and am concerned that the response does not accurately reflect the Working Group’s understanding of Implementation Guidance in the Final Report. I think, on the other hand, that the ICANN ODP correctly stated the Working Group’s
understanding of Implementation Guidance and that this understanding should be affirmed in the GNSO Council Response. The ODP stated its assumption as follows:
For context, we recognize that the Final Report anticipates making all efforts to achieve the
recommended action, and that if something cannot be implemented exactly as specified in
Implementation Guidance, the org would be expected to describe its efforts and rationale for such cases, and to work with the IRT to implement an alternative in line
with the purpose behind the recommended action.
Unfortunately the draft response focuses a lot of language on “flexibility” and does not affirm the above assumption of the ODP staff. Again, I think the proper
response is that the above assumption is correct and the Council’s response should so state.

Thanks Sebastien. JEFF – I am a bit confused by the examples presented in Question Set 6 from the Sub Pro ODP team. The examples are all labelled “Recommendation” and all include the word “must” which has
a defined meaning in the Sub Pro Final Report. The Implementation Guidance does not generally include the word “must”. That word was used consistently in connection with Recommendations and Question Set 6 appears to be reciting “must” Recommendations but
treating them as Implementation Guidance.
Could you please clarify the question being asked in Question Set 6? (I have previously volunteered to join that Sub Pro small team.)
