I am writing to you in my capacity as Chair of the Transfer Policy Review Working Group (“TPR WG”).
As you know from my regular updates to the GNSO Council, the TPR WG is currently planning on publishing its comprehensive Initial Report, which will cover all charter questions, in August.
As we move closer to publication of our Initial Report: I wanted to request two things from the Council:
(i) We have seen a drop in the participation of some of the represented groups (most recent project packages). We have had active participation from both Registry and Registrar representatives, and we know this in part due to the direct impact the Transfer Policy has on these stakeholders. However, because this policy also affects registrants of all kinds, it is important to hear from all represented groups in this WG. The limited participation has led to relitigation of many issues, and, importantly, could lead to recommendations not being supported by the full Working Group, despite multiple years of work by the active members. Accordingly, we ask that GNSO Councilors take the action to check in with their TPR representatives and ensure they are able to regularly attend and participate in meetings or appoint alternates when needed; and
(ii) As we move toward publication, we would like to request an ICANN Board liaison to regularly observe the WG. We have reached a critical point in our work where we believe this is an important addition as we want to ensure the ICANN Board has someone intimately familiar with eventual recommendations that could be sent to the ICANN Board. As a reminder, the ICANN Board has resolved on two separate occasions to defer enforcement of existing consensus policy requirements.*
