That is my understanding, but i stand corrected. Here is the relevant Bylaw language from Article 11.2 (b):

 

Except in a "special circumstance," such as, but not limited to, meeting geographic or other diversity requirements defined in the Stakeholder Group charters, where no alternative representative is available to serve, no Council member may be selected to serve more than two consecutive terms, in such a special circumstance a Council member may serve one additional term. For these purposes, a person selected to fill a vacancy in a term shall not be deemed to have served that term. A former Council member who has served two consecutive terms must remain out of office for one full term prior to serving any subsequent term as Council member. A "special circumstance" is defined in the GNSO Operating Procedures.

Leadership thinks you make a fair point on point #1. So, with the help of staff, we drafted a redline version of the JD with the following language to address that last sentence:

"The ICANN Bylaws stipulate that Councilors shall not serve more than two consecutive two-year terms. A Council member who has served two consecutive terms must remain out of office for at least one full term immediately prior to the term period for which they are seeking to apply.

I have attached the redlined JD here for consideration. 

On point #2 regarding Board Code of Conduct,  we think that’s probably not necessary since it’s supposed to apply to anyone taking part in any ICANN community processes. We don’t think the code of conduct will apply to NomCom Councilors differently in any way.

terms GNSO Council members may serve."    Does this suggest to the Applicant that there are no term limits on NomCom appointees to Council?  I can't remember the source of the limits but this sentence seems a bit misleading.  (We kicked Paul and Desiree off Council after four years each.)

2. Should this document make any reference to Board Code of Conduct once it is finalized?  (The Board is likely to act before applications for the NomCom position are due.)

You can see the 2026 job description attached, which relies on a version that was subject to Council’s review and revisions a few years ago.

Council leadership has reviewed the 2026 job description and believe it remains fit for purpose and can again be used. Our suggestion is to move forward with the current job description for 2026.
