DEAR COUNCILORS, in a very brief look at these slides and certain problem areas noted by ICANN Org in relation to implementing the Recommendations in the Final Report, I have one overall “big picture” question.
In several places of importance, ICANN Org is suggesting a different approach other than that recommended by the Sub Pro WG and approved by Council. So the question is this: What amount of interaction with Council and the policy-making procedures adopted
by Council is appropriate given that the results of the Final Report constitute Consensus Policy and the Council adopted and recommended the Final Report to the Board?
By way of example, I note that there is a Recommendation in relation to Applicant Support that calls for additional financial assistance in the next round, e.g. in relation to fees for application drafting
and legal fees associated with preparing an Applicant Support application. The ODA apparently states this is not feasible and suggests instead that ICANN might reduce certain of its own fees related to applications and potentially other fees going forward.
This topic may be one reason that Council’s Response to the ODP Question Set #6 is so important. In the revised draft I submitted and Jeff accepted, I pointed out that ICANN Org should consult the GGP process
that has been initiated to propose alternative implementation plans. Likewise, that draft was modified to reflect the fact that when ICANN Org runs into an implementation issue and has “valid reasons” for finding the Implementation Guidance is not feasible,
it needs to come back with the appropriate request for input, e.g. via IRT if one is instituted, via GNSO Guidance Process, or via GNSO Input process. It should be noted that in the IRT process, any Councilor can raise an issue to the level of a policy
issue and ask Council to address it.
