Hi Tomslin: Thanks for engaging prior to the meeting! I think your solution, while complete on paper, might impose an undue or impossible burden on working groups and PDP teams. From personal experience, I know the Phase 1 EPDP Team on Registration Data was both spent and had no interest in diving into the conflicts. In hindsight, such a consideration would likely have doubled the Phase I timeline. In addition, an uninterested team will not fashion effective solutions. I say “impossible” because, the PDP teams might not have the necessary expertise to resolve the conflicts. (I’d say likely not.) Experts on registration data might not be experts on the transfer policy. I think there should be flexibility in the process — each one of these instances will be different. The working group should have the flexibility to address the issue if so inclined and capable. The Council should be able to fashion other approaches depending on the situation and (if it makes sense) be able to have that substantive discussion prior to approving the recommendations. It seems incongruous that the Council can modify a Council-approved set of recommendations, but is essentially barred from having a substantive discussion on the same issues prior to the approval.
The Council role in considering policy recommendations for approval is limited to determining whether the Working Group followed the prescribed process. Given that limitation, the Council could not entertain a discussion of the possible collision between the new recommendations and existing policy. Then, according to this draft that we are considering, the instant the Council approves the recommendation, it can discuss amendment of the same recommendations.
I think the draft is fine but should make an allowance for sending the recommendations back to the Working Group before approval if the Council sees a collision with some other policy or for any other reason. The PDP should be amended to allow the Council to conduct substantive discussions in cases where the Council deems they would be efficient and are necessary.
