To add to Kurt’s response, the RySG’s views regarding the Bylaw amendment are as follows:

The Registries Stakeholder Group (RySG) does not support the proposed change as it is broader than the original recommendation.  The RySG is concerned that the proposed change creates an alternate path to amending a Fundamental Bylaw and could create an opportunity for abuse.  If a situation arises that requires an additional future amendment that should be subject to the existing processes.

 

The RySG supports the original recommendation for a change to the Fundamental Bylaw to account for the needs of the Grant Program.

The RySG will also be submitting a separate response to the public comment.

Regarding ATRT4, the RySG sent the note below supporting the deferral to the ICANN correspondence address and the Policy Strategic Management team, at Terri’s instruction:

 

The RySG recommends deferring the ATRT4 Review at this time. We recognize that in its Final Report, the ATRT3 Review Team contemplated starting the ATRT4 Review after the ICANN Board has approved the first recommendation(s) from the Holistic Review, but given the decision to launch a Pilot Holistic Review prior, and the delays in getting that Pilot started, we believe a preferable timeline would be to launch the ATRT4 Review after the Pilot Holistic Review has concluded. This limited deferral should provide for more available volunteers for each and will also allow the ATRT4 to be conducted with the benefit of learnings from the Pilot Holistic Review.

 

Regarding the Bylaw amendment, the RySG will have a brief comment in the next couple days as we are compiling the results of our recent discussion.

Leadership has not received feedback on any SG/C position. However, I can share the tentative RrSG position: the RrSG does not support broadening the original scope of the bylaws amendment beyond that contemplated in recommendation 7 of the CCWG AP (i.e. limiting removal of the accountability mechanisms just for the auction grant program). Among other things, the RrSG is concerned that this broadened scope vests undue power in CCWGs to disallow accountability mechanisms going forward by removing the community safeguard afforded by following a formal bylaws amendment.

Given that Council would need a unified position to submit a public comment, I invite councilors to indicate whether their SG’s position may align with the RrSG’s position. Please provide feedback by 26 March to leave time to draft a comment. If not, I encourage SG’s to submit their own public comments (Council's role as a member of the Empowered Community is not strictly relevant at this stage -- a response is not strictly necessary now)

RE: ATRT4

Please note any objections to supporting a deferral of ATRT4. If there are none, a short letter will be sent by Council Leadership supporting a deferral at EOD 22 March.
