Dear Councilors, I am writing to seek your urgent input on the proposed composition of the Transfer Policy PDP Working Group. Following the call for volunteers (see staff's email below), the Council small team (consisting of Carlton, Olga, Greg and myself) has been working on finalizing the draft charter, mainly on the composition of the Working Group. In coming up with our proposed composition, the small team has taken into account the comments that Councilors made during the February Council meeting (the group size should be around 20) and the community responses to Council chair's email soliciting their interest and number of representatives. Specifically, only the RrSG and the RySG indicated the number of representatives they are likely to assign to this effort: RrSG indicated: 8 - 15 RySG indicated: 2 - 5 The small team is proposing the following group structure (based on a "representative model") to be included in the Charter: each SG/C/SO/AC that did not respond to Philippe's email or responded but indicated "no representatives": 1 member + 1 alternate RySG: 3 members + 3 alternates RrSG: 10 members + 10 alternates For those of you who are not familiar with the PDP 3.0 Improvements, your may find these links helpful: PDP 3.0 Improvement #2: Comparison Table of Working Group Models(10 February 2020) PDP 3.0 Implementation: Revised GNSO Working Group Charter Template(10 February 2020) In order to meet the deadline for submitting documents for the March Council meeting, please provide input or feedback within the next 48 hours, by 23:59 UTC 12 March 2021. All, For what it is worth, I am not sure that I see the value in a closed PDP group at this point especially since there will be 13 members from the Contracted Parties as participants in this group. Speaking as a past Chair/Co-Chair of several PDPs, there really is no difference between a group of 30 and a group of 50. I highly doubt we will have a huge number of volunteers, but if there are some volunteers, I see no reason why the group needs to be limited to an arbitrary number. As the GNSO Liaison to the GAC, however, I believe that it will be difficult for the GAC to agree to be represented by only 1 person. In the past they have indicated that only having 1 person was not something that they would be able to accommodate given that no one person can speak for the GAC. In addition, no one person from the GAC generally can follow all of a group’s activities all by her or himself and therefore they rely at least on a team of three. I do not know if this (transfers) will ultimately be a huge issue for the governments, but if we are serious in trying to get their input in PDPs (prior to them providing advice to the Board), limiting their membership to 1 person does not sound like a way to do it. I would suggest having an open model PDP, but if it has to be hybrid or representative, I would think that having only 1 representative would be an issue for them. Given the short notice, I have not had the opportunity to communicate with my counterpart in the GAC, so I could be wrong. But I am basing my views on past comments made. I am sending this note to my GAC Counterpart as well to confirm. Sincerely, Jeff Jeffrey J. Jeff, Thank you for your prompt feedback. It would be good to know how many would be appropriate for the GAC. Representative model was recommended by the Scoping Team and the GNSO Council chair has consulted with the community on this as well. To my knowledge, the GAC did not respond to the Counci Chair's email (see text below), which was sent on 9 February. Kind regards, Pam ---- Dear Supporting Organization, Advisory Committee, Stakeholder Group, and Constituency Chairs, I am writing to request your input on the composition and timing of a potential GNSO Policy Development Process Working Group (PDP WG) to the Review of the Transfer Policy. As you may know, the GNSO Council requested a Preliminary Issue Report on this topic and has now received the Final Issue Report from Policy Support Staff. The GNSO Council will be considering whether to initiate a PDP to review the Transfer Policy during its 18 February meeting and will also be discussing the composition of the Working Group should it be initiated. The draft Charter included as Annex A of the Final Issue Report describes a Working Group with a representative model and a limited number of members. The following summarizes the proposed roles: · Members, who are responsible for active participation, preliminary deliberations, and consensus; · Alternates, who only participate if a Member is not available, but will be responsible for keeping up with Working Group; · Observers, who may follow the work but do not have posting or speaking rights during WG meetings. The GNSO Council recognizes that the subject matter of this PDP may be of greater interest to some groups than others. We also recognize that community volunteer resources may be limited and available resources may depend on the timing of the PDP’s initiation. Therefore, the GNSO Council is interested in your group’s input on the following questions: · Is your group comfortable with the proposed membership model as outlined above? · Can you provide an indication of how many members you believe your group would like to assign to this Working Group? · Do you have any concerns from a resource perspective about the PDP beginning as soon as possible? If so, please provide details. In order to ensure that your input is considered as part of the 18 February GNSO Council discussion, please provide responses by 16 February at 23:59 UTC. I think the representative model is perfect for an industry-specific, technically-oriented issue like the Transfer policy. A significant number of registrars and registries can figure out the details that will work across the industry while a limited but consistent number of other community members can provide oversight, safeguarding the interests of registrants. Hi Pam, Considering that feedback and responses received from the community consultations align with the scoping team's recommendation, I believe the proposed composition model is fine and should be used for this PDP. I saw the chair's community consultation on the issue as a means of data collection to inform the small team's work and our decision making. If GAC or any other group didn't think it important to inform the process of their desired number of participants, we can only assume disinterest in the topic and work. In coming up with our proposed composition, the small team has taken into account the comments that Councilors made during the February Council meeting (the group size should be around 20) and the community responses to Council chair's email soliciting their interest and number of representatives. Specifically, only the RrSG and the RySG indicated the number of representatives they are likely to assign to this effort: RrSG indicated: 8 - 15 RySG indicated: 2 - 5 The small team is proposing the following group structure (based on a "representative model") to be included in the Charter: * each SG/C/SO/AC that did not respond to Philippe's email or responded but indicated "no representatives": 1 member + 1 alternate * RySG: 3 members + 3 alternates * RrSG: 10 members + 10 alternates For those of you who are not familiar with the PDP 3.0 Improvements, your may find these links helpful: PDP 3.0 Improvement #2: Comparison Table of Working Group Models<https://gnso.icann.org/en/council/pdp-3-2-working-group-models-10feb20-en.pdf>(10 February 2020) PDP 3.0 Implementation: Revised GNSO Working Group Charter Template<https://gnso.icann.org/en/council/pdp-3-revised-wg-charter-template-10feb20-en.pdf>(10 February 2020) In order to meet the deadline for submitting documents for the March Council meeting, please provide input or feedback within the next 48 hours, by 23:59 UTC 12 March 2021. Re the general point about WG composition: For this particular PDP I think the structured representation model is appropriate for the reasons Kurt mentioned. Although we need to be careful about it becoming the default mode by practice. Re the point about GAC representation: I see no problem with accommodating the GAC’s request for 3 places. I would note that the GAC Chair specifically mentions the GAC Public Safety Working Group, which perhaps is an indication of the public policy angle they may be coming from. Hi Pam Thank you for the work on this. I think the model is great and I think it’s good to have a limit on this. We need to make sure a PDP is not flooded with to many members. Reaching out to each SG/C/SO/AC before and asking for their expected participation is a good way to set the limits in the PDP charter. Kind regards Kristian Ørmen
