Letter from RPM PDP co-chairs on GDPR & domain name dispute resolution
Dear Councilors, Please find attached, for your review and discussion, a letter from the co-chairs of the Review of All Rights Protection Mechanisms (RPMs) Policy Development Process Working Group relating to the impact of the General Data Protection Regulation (GDPR) on the provision of domain name dispute resolution services under the Uniform Domain Name Dispute Resolution Policy (UDRP) and the Uniform Rapid Suspension procedure (URS). The letter references and includes an attachment containing relevant provisions of the UDRP and URS Procedures and Rules that may, and in some cases do, involve the use of Whois and personal data in proceedings brought under these processes. Dear Mary, Julie, Ariel (ICANN staff), and Phil, Kathy, Brian (RPM PDP WG co-chairs), On behalf of the Council leadership team, thank you for your initiative and for providing this analysis as Council turns its attention to the (E)PDP and its requirements. I'll suggest that we channel any questions raised on the Council list between now and the 24 May meeting through Paul as liaison. If questions relating to RPM PDP come up in the 21 May Q&A webinar, we will channel those back to you promptly after. The May Council agenda (draft to be posted soon) prioritises a bulk of the meeting time to GDPR/RDS next steps, and your information will help to inform that discussion.
