Update on SPIRT Charter Drafting Team
Dear Council Members, I have just been advised that I will be providing a briefing to Council on the SPIRT Charter Drafting Team work in our June 12 meeting in Kigali. Staff is currently preparing a slide presentation to assist me in this task. Given the short time frame to the June 12 meeting, I did want to let Council members know that among other developments, the team achieved consensus today on a requirement for participants on the SPIRT team to disclose (initially and on an ongoing basis) the identity of persons or entities to which the member provides legal, financial, consulting or other services. The team concluded that this Charter language recommendation follows naturally from the "additional information" language in Annex E to the effect that Council may specify member disclosure of additional information as it sees fit. The slide presentation will also cover other amplifications/variations to the Final Report Annex E Implementation Guidance for the SPIRT. I don't know how much time will be allotted for this discussion on the agenda but thought it best to highlight the above issue so that Councilors may be adequately prepared, recognizing that they may need to consult their SGs and Cs on this point. I realize there will also be a need to share the draft Charter language generally with your SGs and Cs, but note that the Charter will not come before Council for a vote until our July meeting. By way of further information on the requirement for disclosure by lawyers and consultants of specific entity and/or client identity as a condition for those applying for membership on the SPIRT team (as contained in the current draft Charter document), please see the language below taken from Annex E in the Sub Pro Final Report: The Statement of Participation should include all of the usual elements of a GNSO Statement of Interest plus additional information the GNSO Council may see fit, including but not limited to, whether the participant is (or will be) employed by, under contract with, has a financial interest in, or providing consulting, financial, legal or other services to, any new gTLD applicant, objector, or commenter. The Statement of Participation is not intended to exclude any person/entity from participating, but rather to provide complete information about the participant to the community.
