Dear Colleagues, Further to our development session call of this morning, here is an article on the Terms of Reference in commercial arbitration proceedings. It describes what these Terms are about and what they are meant for. The concept can be an inspiration for complementing PDPs. Now, PDPs have a Charter. At some early point in the PDP WG’s activities, Group and Constituency representatives could be asked to contribute to Terms of Reference reflecting each other’s interests, views and goals. This approach may add clarity to the respective expectations and positions quite soon in the process.
