Thank you. Kind regards, Terri 2025061-1 **Consent agenda Motion to Defer Further Work on Whois Implementation Advisory Group and the Whois Conflicts Procedure Submitted by: Greg DiBiase WHEREAS, 1. In November 2020, the GNSO Council requested<https://www.icann.org/en/system/files/correspondence/fouquart-to-swinehart-0...> ICANN org, in consultation with Contracted Parties, to draft proposal for a modification to the existing WHOIS Conflicts Procedure on past experience with both the WHOIS Conflicts Procedure and the registrar data retention waiver process; 2. In March 2021<https://www.icann.org/en/system/files/correspondence/swinehart-to-fouquart-1...>, June 2021<https://www.icann.org/en/system/files/correspondence/swinehart-to-fouquart-2...>, and September 2021<https://gnso.icann.org/sites/default/files/file/field-file-attach/swinehart-...>, ICANN provided updates to the GNSO Council on the progress of this work, noting in its most recent update in September 2021 that ICANN org and Contracted Parties had mutually agreed to “focus on the completion of the data processing agreements associated with the Expedited Policy Development Process (EPDP) on the Temporary Specification for gTLD Registration Data Phase 1 implementation work prior to further developing the WHOIS Conflicts Procedure”. 3. Following publication of the Data Protection Specification in January 2025, the GNSO Council resumed discussions regarding how to proceed with this work. 4. The Council had a detailed discussion during its April 2025<https://icann.zoom.us/rec/play/6PhbG0pgPMXH6qmGbtcbMd7ZtelTAgiXOBOBUOvkX_cNj...> meeting, followed by an agreement during its May 2025<https://icann.zoom.us/rec/play/YeU3aCuvtGQkwsuAwdIBEKFevyM-hhAo5zaZOzvAXe9XZ...> meeting that given the lack of urgency or necessity to review this procedure, the Council agreed to defer further work indefinitely until a need arises. RESOLVED, 1. The GNSO Council adopts the motion to defer further work on the Whois Implementation Advisory Group and the Whois Conflicts Procedure until a need arises, i.e. until the ICANN community communicates that further work is needed and the GNSO Council agrees with this assessment. 2. The GNSO Council requests GNSO Support Staff to inform ICANN org Global Domains & Strategy Team of this motion.
