Update from EPDP team & Questions

Hi all Here some brief update from the EPDP team. The team spent the last calls (90min call per week) since Janis started his role as chair early this month to discuss the approach to be followed for phase 2, including also the review the legal questions and the tools the team will use for deliberation. I attached the slides presented in last call to explain the approach ,includes a rough high level timeline and next steps till Marrakech meeting. Please let me know if you want more details. I also got request for clarification in the last call. As expected, there was interest within EPDP team with regard to board resolution on EPDP phase final report and policy recommendations. The EPDP team is seeking clarification from the GNSO Council regarding the Bylaw-triggered consultation process following the non-adoption by Board of parts of GNSO Council approved recommendations. I understand that council can realistically respond to this after our extraordinary meeting on board resolution next week. Best, Rafik

Hello Rafik, I have a question on the item of 'Additional purpose for ICANN’s OCTO' The question is: How ICANN’s OCTO can have any purpose, different from the purposes of ICANN at all ? It does not exist from the legal perspective for outsiders (nobody cares about the department structure outside of the same organisation). BTW - if it has any purpose different from ICANN's - it might be a sign of mutiny. (disclaimer, 7-8 words to the left not to be taken seriously). Hi Maxim, My understanding is that the reference to OCTO is just a convenient shorthand but the EPDP team is aware that this would be an ICANN purpose and not just a department purpose only. I am putting here as reference the the full text of the recommendation : "The EPDP Team commits to considering in Phase 2 of its work whether additional purposes should be considered to facilitate ICANN’s Office of the Chief Technology Officer (OCTO) to carry out its mission (see https://www.icann.org/octo). This consideration should be informed by legal guidance on if/how provisions in the GDPR concerning research apply to ICANN Org and the expression for the need of such pseudonymized data by ICANN." Hi Rafik, There is an issue here, OCTO does not exist from the legal perspective at all (outside of internal ICANN management procedures, which are not important here, because the responsibility for what ICANN Org does with the personal data is on the whole organisation, and not limited to one of the departments, which is not an independent organisation). OCTO is not in ICANN bylaws or California law , it can not be found in ICANN policies or contracts with CPH, and so far I do not see any value in adding it here, it should be replaced with 'ICANN Org', to avoid further confusion. And for sure, we should not solidify dependance on some URL on the website of ICANN in the policy statements ( https://www.icann.org/octo <https://www.icann.org/octo> is a webpage, which can be changed at any time without any kind of due process). Hi all, As I don't see any objections or concerns, I will go ahead and work with Keith to get a formal request submitted to the ICANN Board to confirm the resource request for the 2 F2F meetings as outlined in the timeline (Sept 2019 & Jan/Feb 2020). We need to do this asap having in mind the constraints regarding travel arrangements and avoid impacting the EPDP members who have to apply for visa.
