Dear Chantelle Doerksen,
Greetings and thank you for sharing the documents vide the trace of this mail.
A domain name remains a purely technical resource. It has seldom been easy
to apply a property right, be it intellectual or industrial. The holder of the domain name "has a right to use" & its provider" manages it more than it owns it".
The volatility of domain names and their technical nature make them hard for the law to grasp.
REAL CONCERN:
When the domain name is not protected by a trademark right ?
The table of
Use Cases is a very good idea.
Can we also mention
the countries where the Closed Generic Use Case Described also has a legal protection if at all ?
Sincerely,
From: CPWG <cpwg-bounces@icann.org> on behalf of Chantelle Doerksen via CPWG <cpwg@icann.org>
