Assuming that the Board will finalize its decision on the 10th of November and the ECA will receive the Secretary's Notice promptly, the ccNSO is in favor of having the Approval Action Community Forum at ICANN 81, however with the caveat that we have some questions that need to be answered first:
  1. Who will Chair the Community Forum? Due to the nature of the topic, I propose it should be either the gNSO ECA representative or the gNSO Chair.
  2. Who will present from ICANN Org? Last time it was Sam Eisner.
  3. Who from the ICANN Board will be present?
  4. Is there a communication plan to announce the Community Forum properly?
  5. How will the timing of the Community Forum as part of  ICANN81 affect the Approval Action Community Forum Period?

On 7 August 2024, ICANN Board opened a Public Comment proceeding on the “Proposed Fundamental Bylaws Amendments Related to the Grant Program.” This proceeding closed on 16 September 2024: https://www.icann.org/en/public-comment/proceeding/proposed-fundamental-bylaws-amendments-related-to-grant-program-07-08-2024 

 

The ICANN Board reviewed these Fundamental Bylaws amendments during its meeting on 24 October 2024. As a result of its review and discussion, the Board indicated that “...it intends to take an action to approve the amendment of the Fundamental Bylaws at Article 4, Section 4.2(d) and Section 4.3(c), as posted for public comment when it has sufficient attendance to achieve the required voting threshold for a Fundamental Bylaws amendment.” https://www.icann.org/en/board-activities-and-meetings/materials/approved-resolutions-special-meeting-of-the-icann-board-24-10-2024-en#section2.d. 

 

The Board intends to complete its action on the Fundamental Bylaws amendments no later than 10 November 2024, and the ICANN Secretary will deliver written notice to Empowered Community Administration as required by the ICANN Bylaws. 

 

Delivery of the Secretary’s Notice will (1) require Decisional Participants to “promptly inform their constituents” of the delivery of such notice; and (2) trigger an Approval Action Community Forum, relating to the Grant Program, to be convened and concluded during the period beginning upon the Approval Action Board Notification Date and ending at 23:59 (Pacific time) on the 30th day after the Approval Action Board Notification Date; or during the next scheduled ICANN public meeting. Please refer to Article 1.2, Annex D of the ICANN Bylaws for additional details on the Empowered Community Approval Process https://www.icann.org/resources/pages/governance/bylaws-en/#annexD and note that an Approval Action Community Forum is convened at the direction of the EC Administration.

 

In anticipation of a potential Approval Action Community Forum on this topic at ICANN81, support staff for the Empowered Community Administration has worked with the ICANN81 planning team to add a placeholder to the ICANN81 schedule, for a Community Forum to be held on Thursday, 14 November 2024 at 06:00-07:00 UTC (09:00-10:00 Istanbul time).

 

We are providing you with an update on this Fundamental Bylaws amendment process so that you can inform your communities accordingly. Please let us know whether the Empowered Community Administration prefers to hold this Approval Action Community Forum in the form of a teleconference to be held within 30 days from the receipt of Approval Action Board Notice, or as an in-person meeting during ICANN81 on 14 November 2024. It is also possible to convene a Community Forum in person during ICANN81 and have a further Community Forum in the form of a teleconference within the Approval Action Community Forum, if the Empowered Community wishes to do so.
