Dear Empowered Community Administration representatives,
I am writing to confirm that, in accordance with the timelines and procedures set out in Annex D of the ICANN Bylaws, the 21-day Rejection Action Petition Periods pertaining
to the (1) FY23 Operating Plan and Budget and (2) FY23-27
Five Year Operating and Financial Plan that were approved by the ICANN Board expired at 06:59 UTC. No Rejection Action Petition Notices (as defined in Annex D, Section 2.2(c)(i)) were received by the Empowered Community Administration within the prescribed
timeframe.
Therefore, under Annex D, Section 2.2(c)(ii), the Rejection Processes for the (1) FY23
Operating Plan and Budget and (2) FY23-27
Five Year Operating and Financial Plan are thus automatically terminated. The next step is for the Empowered Community Administration to deliver to the ICANN Secretary two notices certifying that the Rejection Processes have been terminated with respect to
these particular Rejection Actions. ICANN will then post the Rejection Process Termination Notices on the ICANN website.
As customary, support staff prepared Rejection Process Termination Notices
for your review (see attached).
We note that the Bylaws (Annex D) require that the Empowered Community Administration’s notices
be delivered within twenty-four (24) hours of the expiration of the Rejection Action Petition Period. As such, staff will be happy to forward the notices
on your behalf unless you have comments or concerns.

Dear Empowered Community Administration representatives,
Under the ICANN Bylaws, delivery of the Secretary’s Notices
on 27 May: (1) requires Decisional Participants to “promptly inform their constituents” of the delivery of such
notices; and (2) triggers two
21-day Rejection Action Petition Periods, during which an individual may submit a petition to any Decisional
Participant, seeking to reject the Board action.
These 21-day periods for (1) FY23
Operating Plan and Budget and (2) FY23-27
Five Year Operating and Financial Plan both commenced on 27 May 2022
and will end at 23:59 PDT on 17 June 2022,
or 06:59 UTC on 18
June 2021. Please refer to Article 2, Annex D of the ICANN Bylaws for additional details on the Rejection Process, including all pertinent deadlines and requirements for Rejection Action Petitions:
