Hi ADC PDP WG members, Hope this finds everyone well. The RrSG has put together some proposed text changes for the GAC's request on Recommendation 1 for changes to "is being used" to potentially "was being used, is being used or matches an established pattern of abuse". RrSG new proposed language: When a registrar has actionable evidence giving rise to a reasonable belief that a Registered Name is being used for DNS Abuse, pursuant to Section 3.18.2 of the Registrar Accreditation Agreement (RAA), the registrar must perform an Associated Domain Check (ADC). For the avoidance of doubt, this requirement does not extend to compromised domains. In addition, we believe adding in Implementation Guidance expanding on the above could help: The phrase "is being used for DNS Abuse" is not limited to abuse that is active at the time of review. For purposes of triggering an Associated Domain Check (ADC), registrars may rely on actionable evidence of current, recent, or otherwise well-evidenced DNS Abuse, including where the domain is no longer active or the abusive activity has ceased. Such evidence serves only to trigger the ADC and does not, by itself, require action against the Registered Name or any associated domain. Looking forward to further discussions next week.
