One follow up question for you.  When we met as a small team on this topic, one of the concepts discussed was that confidential requests shouldn’t automatically remain so indefinitely.  I’m curious if you considered this at all and if so, why it wasn’t included in the proposed draft text.

Chris and I have been hammering out some draft text for Building Block H, sub-bullet (h) (Caitlin’s Action Item #3, below).  Chris is offline at the moment, but here’s where we have landed for discussion during tomorrow’s call:

 

Disclosure of RDS data to the type of third parties must be made clear to the data subject. Upon a request from a data subject the exact processing activities of their data within the SSAD, should be disclosed as soon as reasonably feasible.

However the nature of legal investigations or procedures may require SSAD and/or the disclosing entity keep the nature or existence of these requests confidential from the data subject. Confidential requests can be disclosed to data subjects in cooperation with the requesting authority, [and] [or] in accordance with the data subject's rights under applicable law.
