In initiating the current PDP and this Working Group, the GNSO Council was careful not to presume either that the existing dispute resolution processes should be changed, or that a new procedure would be created. For your reference, the specific language used by the Council in its resolution was as follows:

"The GNSO Council hereby initiates a PDP to evaluate: (i) whether the UDRP and/or URS should be amended (to enable their access and use by IGOs and INGOs whose identifiers had been recommended for protection by the IGO-INGO PDP WG) and if so, in what way; or (ii) whether a separate narrowly-tailored procedure modeled on these curative rights protection measures to apply only to protected IGO and INGO identifiers should be developed.”

The Charter as approved by the GNSO Council following its initiation of the PDP was also similarly neutral: http://gnso.icann.org/en/drafts/igo-ingo-crp-access-charter-24jun14-en.pdf. The Charter also explicitly lists certain preliminary activities and research that ought to be conducted by the WG in order to assist with its evaluation of whether changes or a new procedure is needed.

On the general question of the relationship between this WG’s work and the issue of IGO-INGO protections as a whole, both the Council and the Board’s New gTLD Program Committee (NGPC) have been careful also to “carve out” the question of second level dispute resolution (to be dealt with by this WG) from their ongoing discussions relating to the remaining GNSO consensus recommendations that are yet to be adopted by the Board (i.e. duration and nature of protections for certain Red Cross organizational names and identifiers, and for IGO acronyms). The GNSO Council’s intention therefore seems to be for this current WG to begin and carry on its work in accordance with the approved Charter, as would be the case with all other GNSO Working Groups. While there may be other “moving parts” that relate to other aspects of the original PDP recommendations, the Council has indicated that these will be managed by the Council separately from the policy question that has been referred to this WG for the current PDP.

I hope the above clarifies the situation. Staff will, of course, prepare all the necessary background documentation and provide an initial informational briefing to all WG members once the group commences its work, so that everyone is up to date on both the task that has been referred to this WG as well as the status of any potentially related updates on other recommendations being considered by the GNSO Council. 

As mentioned previously, this WG , like all other GNSO WGs, also has a Council liaison (Petter Rindforth). During the course of this PDP, should the WG have any further questions about (for example) possible implications of developments elsewhere on its work, Petter will be the primary interface between the Council and the group on these and other such questions.

Aso thia WG assumes the recommendation will be adopted and we are dealing with UDRP conflict related issues only?

Where is the WG issue relative to the IGO issue as a whole.  Working from a presumption not only begs the question but will be used to sustain the original presumption (that NGOs should bne protected).

The short answer to Phil’s question is, thankfully, no – the Working Group that the proposed GNSO Council resolution makes reference to is not this WG but, rather, the original PDP WG that between October 2012 and November 2013 produced consensus recommendations on a number of possible top and second level protections for IGOs and INGOs.

One noteworthy point for this new WG that you’ve volunteered for is that (as some of you know) the basis for our work actually stems from one of the consensus recommendations of that original PDP WG. This is the question of dispute resolution, at the second level, for IGOs and INGOs – viz.  should the existing UDRP and/or URS be amended to more fully accommodate the particular circumstances and needs of these types of organizations, or should a separate, specific procedure be developed for their use (if at all)? The original PDP WG had reached consensus that this question should be explored further, first through an Issue Report and then, if voted for by the GNSO Council, through a separate PDP. Our WG is a direct result therefore of the GNSO Council’s accepting that original recommendation, calling for an Issue Report (published in March 2014) and then voting (in June 2014) to initiate this PDP and create this current WG.

Returning to Phil’s question, basically the GNSO Council’s discussion this Thursday will not involve the policy question that has been posed to this WG. The Council’s discussion will focus on other issues stemming from the original PDP recommendations instead. As such, if the Council decides to reconvene the original PDP WG (as called for in the draft resolution), there may be a slight impact on our WG in terms of timing of our initial meetings but not necessarily in terms of substance.

However, in just reviewing the draft resolution to be voted upon by the GNSO Council this week https://community.icann.org/display/gnsocouncilmeetings/Motions+24+July+2014 , I note this portion:

 

3.The GNSO Council requests that the IGO-INGO PDP WG provide the Council with its recommendation in relation to the proposed amendment/modification within forty-five (45) days of the reconvening of the WG;

4. The GNSO Council requests that, within seven (7) calendar days of this resolution, ICANN staff publish the proposed amendment/modification for public comment for a period of not less than thirty (30) days; and

 

Is my reading correct that the lifespan of this WG, as proposed in the draft resolution, is to be a scant 6.5 weeks, and that ICANN staff would propose amendments of the policy for IGOs/INGOs next week, before the WG has done any substantive work? There is no possible way the WG could consider all of the complex issues (pointed out in the staff report on this matter) in a month-and-a-half, and what is the point of it if staff are to draft amendments/modifications before the WG has proposed anything?

Thank you so much for starting the ball rolling, and a warm welcome to you and everyone who has signed up so far to this Working Group!

 

ICANN staff will be working with Petter Rindforth – GNSO Councilor who has agreed to serve as the GNSO Council liaison to this Working Group and who will be the interim chair until the group selects its permanent chair(s) – to set up an initial meeting for the group soon. The GNSO Council is meeting later this week to discuss a request from the ICANN Board’s New gTLD Program Committee in respect of the outstanding (i.e. not yet adopted by the Board) recommendations of the original PDP Working Group for overall top and second level protections for international organizations. We will consult with Petter as to appropriate timing for the first meeting of this group following the GNSO Council discussion, and revert to you all soon.

 

In the meantime, do remember to fill and send in your SOIs and please feel free to introduce yourselves via email to this list as George has kindly done.
