Lars Hoffmann: Welcome to the IRTP Part D PDP WG Meeting, Monday 28 October 2013
Julia Charvolen: Chris Chaplow joinedd the meeting
Julia Charvolen: Volker Greimann joined the call
Avri Doria: I think if we don't give the registratn a right to initiaite or her own, we must have a forcing function.
Avri Doria: willwe make this an ombudsman duty?
Avri Doria: the ombudsman already has this jurisdiction, i expect, it is just that most registrants would not know this.
Chris Chaplow: Isnt Ombudsman only cases against ICANN corp and not the stakeholders, must be compliance?
Lars Hoffmann: Current 'job description' of the Ombudsman:
Lars Hoffmann: http://www.icann.org/en/help/ombudsman
Holly Raiche: @Chris - that is my undeerstandingfor Ombudsman jurisdiction
Avri Doria: ombudsman can take any case where soemone has been treated unfairly, unless they are an employee
Avri Doria: look at the case he filed against the ICC dispute resolution services.
Avri Doria: filed on behalf of someone who wanted to file an objection and was late inpaying.
Holly Raiche 2: I just had a look at the link Lars provided - and it confines Ombudsman jurisdiction to what ICANN does - so we would need to clarify the jurisdiction issue
Avri Doria: reading http://www.icann.org/en/about/governance/bylaws#V i am not sure it would extend to registrars, but to a dispute resoltion service has already been shown.
Avri Doria: so it would be a question.
Avri Doria: Volchers solution seems very burdenson on the registrant
Avri Doria: I think there if the registrant can't do it themselves, someone need to be reponsible for doing on their behalf.
Volker Greimann: Avri: The registrant must always be responsible, as the registrant is under normal circumstances the only party actually interested in this
Avri Doria: nothing new aded
Volker Greimann: you have sun? lucky you. been raining here all day
Holly Raiche 2: Agree with the fundamental principle of registrant access to appeal
Volker Greimann: Mikey: I agree, that is my impression as well.
Volker Greimann: instead of designing two processes that do what they are supposed to do, we are overloading one process with additional goals
Holly Raiche 2: makes sense to me
Avri Doria: Registrant issues do need to be dealt with, even if they are white whlies.
Avri Doria: whales
