  Kristine Dorrain:One reminder:  in the TDRP, the losing Registrar always pays.....
  Kristine Dorrain:We only need to decide if/how to do a loser pays in the case of the Registrant/claimant

  Kristine Dorrain:Avri:  There is an issue in the case of a Registrant-claimant as to *who* exactly the "losing party" is
  Bladel:SPeaking individually, This idea could be a deal-breaker for allowing registrants access to the TDRP
  Avri Doria:perhaps then we are looking for somethng other than aan ICANN DR process.

  Bladel:Yes, we have become creatures of our environment. :)
  Kristine Dorrain:James, it's hard to think of a policy that works for registrars that do work hard for their customers and to resolve conflicts and how to deal with really PITA registrars.
  Bladel:Espeically given that the latter will just pass those fees thru to the affected party.
  Avri Doria:i owuld assume that registrars that do the right thing and serve their customers are not the ones that will be hit by these disputes.
  Avri Doria:well if passing the fees through to the a third party bad buy is an option, then what is the problem?
  Avri Doria:... a thrid party bad guy ...
  Volker Greimann:I can see how this would be modeled on the UDRP, so if you bring a process, you pay
  Kristine Dorrain:Actually Avri...people who use good registrars still get their names stolen.

  Marika Konings:Do note that the publication deadline for Buenos Aires is 28 October....
  Marika Konings:so if the intention is to obtain community input during BA, you are expected to publish by that date.
  Marika Konings:However, if you are only planning to present / share the findings of the report, there may be more flexibility
  Marika Konings:You may also want to consider to present the report during BA and then formally publish it right after BA for public comment
  Marika Konings:to not get into trouble with the publication deadline and people complaining about releasing documents just prior to an ICANN meeting
