Sorting of public comments
Dear all, Further to my note below, we have sorted the public comment into two rough categories that we hope will assist with your review of them: http://forum.icann.org/lists/ordered-comments-ppsai-initial-05may15.html. You¹ll note that there are basically two ³categories², the difference being that for one we included all messages that were received with particular words/phrases in the subject title and as such tagged as messages that originated with a template or form email. The other category is basically everything else. As this sorting was based on subject title rather than a content search, some template/form messages will not have been identified and placed in the first category. Please note the following: For (1) - this incorporates all Template responses received covering the first 9 of the WG¹s 20 Preliminary Recommendations. It therefore is not a complete collection of all the responses received to all the preliminary recommendations, and does not include comments on the WG¹s open questions. This version of the Tool also incorporates those comments received in the Public Comment Forum that specifically addressed one or more of the 9 preliminary recommendations covered. As staff continues to collate and catalog the remaining Template responses and public comments, we will prepare a second version of the Tool. We hope to be able to complete this exercise by the end of next week, if at all possible however, for now we wanted to get what we were able to do since the Forum closed on Tuesday to you as early as we could.
For (2) - this was derived from the 352 Template responses we received, of which 208 were started but not filled out (although at least one person then sent their responses to the Forum as a public comment, and it would appear that a few others returned and filled out at least part of the Template as a separate response subsequently).
For (3) - please note the disclaimer and explanation included in the document. This document was prepared in the hope that it would help WG members as you go through the over 11,400 public comments received but it is a collection of excerpts only and as such not at all a comprehensive representation of either the scope, variety or number of responses in the Forum.
Finally, again in the hope that it will aid your review of the public comments, our IT department will be categorizing all the comments into at least two groups, one being those that originated with form or template letters. We will send that to you as soon as we receive it; please note, however, that the ³separation² can only be done by subject title and as such there will be some form letters that are not captured this way.
Please let us know if we have made any errors or omissions in our compilation and collation!

Hi Mary, thank you for this preliminary sorting. Having looked at the comments, I still expect that we have a herculean task ahead of us, as even within the "Respect our Privacy" submissions, there are a lot of substantial, well-considered and helpful comments hidden away. I expect we will have to sort that category at least once more, into a section where just the form letter was submitted and a section where additional comments have been added. I also feels strongly that even if those comments do not directly respond to the questions asked in the initial report, they clearly show that the topic of whois privacy is important to many internet users and we should ensure that our work takes these comments into account and convey to the commenters that their voices have been heard. Hi Mary and All, I would add to Volker's comments that I would like to ensure that the "sorting" process is not a way of eliminating or minimizing any of the contributions/comments that we have received. We have received a huge number of comments -- a real outpouring of input -- and it is critical that we find a good way to understand the scope and breadth of the contribution, and give it true and meaningful impact in our work ahead. Hello Kathy, Volker and everyone thank you for your feedback. Besides some technical challenges, they are one of the reasons that the sorting was done only at the subject title level. Staff has manually looked at most (though not all) of the submissions received to make sure that as much as possible we have not inadvertently sorted them wrongly. In addition, we hope that the staff summary of the other comments received is helpful to you and your groups as a starting point, as you proceed to review the contributions we received . Having prepared the summary, Public Comment Review Tool and general data analysis that we circulated on Friday, it wouldn¹t be appropriate for staff to determine further categorizations or analysis. As such, we expect the co-chairs to discuss with you the WG¹s preferred method of reviewing the comments to ensure that our Final Report reflects an accurate consideration of the feedback received. Agreeing that analyzing the comments will be a herculean task, I would urge that the methodology used seek to identify those areas where there is substantial consensus. I do that because at least week's Congressional hearing on ICANN, CEO Chehade was asked about the outpouring of comments expressing privacy concerns, and my notes recoded his response as "clearly, there is not consensus, and without consensus it doesn't get forwarded". Hello everyone - the Final Report will list all the recommendations and note the level of support for each (the various possible levels of support are listed in the Working Group Guidelines). The whole report is forwarded to the Council for its review. While the Council has the final vote as to what is adopted, I believe that it is highly unusual for the Council to adopt recommendations that did not at least receive consensus support, even if this is not necessarily full consensus (both as defined in the Guidelines). Of course, adopted recommendations are then subject to further public comment and Board review, and the Bylaws are very specific as to the voting thresholds that the Board will need in order to reject a consensus recommendation from the GNSO. The main idea, of course, is that policy is made bottom up and by stakeholder consensus. I hope this helps! Paul In my experience if we, as a group, sent something like that to Council that won’t happen. The GNSO Council isn’t going to be able to resolve issues in a PDP. The Working Group would have to. However, Fadi used the word “it” which is singular (as opposed to X, Y & Z / A, B & C issues which are plural) and I was concerned that he was stating that if we don’t have consensus on all of the items, the PPSAI report “won’t get forwarded.” So long as we aren’t operating under a different paradigm than the usual, my concerns are addressed. That quote was based on my handwritten contemporaneous note of what Fadi said in response to a question from a Congressman concerned about the P/P issue’s privacy’s aspects, so I wouldn’t parse it too closely and would also assume that Fadi was trying to allay his concerns. I’d presume that Board reception of a final Report will proceed along normal lines, but perhaps with a heightened sensitivity – recommendations that get broad WG consensus get adopted, those that don’t fall by the wayside or are kicked down the road. As just stated in an email I posted, I believe that taking the necessary time to fully consider all substantive comments will not only build a more defensible record underlying our final recommendations, but will increase the possibility for finding consensus middle ground on at least some of the open issues. I also feels strongly that even if those comments do not directly respond to the questions asked in the initial report, they clearly show that the topic of whois privacy is important to many internet users and we should ensure that our work takes these comments into account and convey to the commenters that their voices have been heard.
