Thank you Steve for providing a basis for discussion, however I felt the need for certain changes. Please review the enclosed revised draft for a more balanced proposal. This draft: - removes the requirement of service providers to make legal determinations they are not qualified for - ensures that only the minimum of data required for the complainant to assess further steps is required to be disclosed, but more may be at the choice of the provider - reduces the risk of unsubstantiated or erroneous claims by including an obligation to legally certify (and be sued if wrong) all statements We might also want to think about an indemnification requirement. Agreed, ideally, the proposed procedures and requirements would be identical for any form of abuse, from copyright infringement to spamming. All equally bad, so there is no reason to handle them differently. I do believe however the standard of evidence required should be far beyond the "good faith belief" proposed by Steve and rather be in the realm of "sworn statement that can be used in court and carries penalty if false in any way". Agreed, ideally, the proposed procedures and requirements would be identical for any form of abuse, from copyright infringement to spamming. All equally bad, so there is no reason to handle them differently.
I do believe however the standard of evidence required should be far beyond the "good faith belief" proposed by Steve and rather be in the realm of "sworn statement that can be used in court and carries penalty if false in any way".

We might also want to think about an indemnification requirement.

The discussion draft gives intellectual property complaints as an example because that is an area where the drafters know well from long experience how to state a case. We need the input of people with comparable expertise in the other types of abuse involved. The proposal is to state a general policy and then to give one detailed example. There are arguments on both sides of this question, but the advantage of this approach is that by spelling out how the general policy would be applied in a specific case it enables a better evaluation of whether the general policy is set at the right point.
