Hi Mary

Thanks so much for your input on the Sub Group A call today.  Would you be able to provide some clarification to the comments you made right at the end of the call about ICANN Org’s input on Sunrise Rec #2 please?  I went back to the recording, to be sure I hadn’t misheard you, and you commented that Org was saying “give us more detail about how you think this recommendation will work in the specific context of Spec 7, particularly section 1 of Spec 7, because it’s possible that some could read this as contrary to section 1”.

I had not understood Org’s comments in that way, but rather that, if this recommendation stands, then Org is expressing the need for this to be implemented with sufficient specificity to enable them to enforce it.  I have looked back at Spec 7 section 1 (https://newgtlds.icann.org/sites/default/files/agreements/agreement-approved-31jul17-en.docx), which requires the RO to implement the mandatory RPMs and permits them to implement additional self-adopted RPMs.  I cannot immediately see where or how a recommendation from this WG that ROs be under a contractual obligation not to operate their TLD in a way which circumvents the mandatory RPMs would be inconsistent/contrary to Spec 7 section 1.  Can you please clarify what the concern is?

Many thanks

Susan
