Is the ban on non-apex RRs (such as an SRV for _nicname._tcp.[TLD]) other than delegations at all driven by the fear that too much of the world is using BIND's "root-delegation-only" with an exclude list that they won't change to include new gTLDs (or any equivalent in other recursive nameserver implementations)?
