ICANN83 IRT Meeting Information and Discussion Paper
Dear IRT, I hope you’re all doing well. As you know, ICANN83 is almost upon us and we have 2 meetings in the book – Monday and Wednesday morning at 8:45 UTC, 10:45 on the ground. Best wishes and safe travels to all making the trip to Prague in person, as well as a warm invite to those joining online. Many of the IPT team are on the ground, including myself, and I look forward to meeting many of you in person for the first time. In advance of our meetings , I would like to share a discussion paper that will structure and inform our time. Apologies for not sharing this sooner, but the staff team took a considerable amount of time to rigorously review and hone the document to ensure that it would best support our session proceedings and goals: IRT Drive Link: ICANN 83 IGO-INGO Curative Rights IRT Discussion Paper on EPDP Recommendations 2-5<https://docs.google.com/document/d/1SbC1J5IlFZDzcrFUk189G1acATlP2oi6cCgsXvkM...>. I have also attached the document in Word format. The paper examines EPDP Recommendations 2-5 and seeks to draw on the IRTs experience to document a shared understanding of the policy content and intent of the recommendations, as well as identify and discuss potential next steps in their implementation. The paper revolves around sets of IRT “topics for discussion”, structured to elicit the IRTs opinion, interpretations, and guidance. ICANN org will collate and consider the IRT’s responses and use them to develop its implementation next steps, which will be presented to the IRT at a subsequent meeting. There is also an Annex detailing the findings of ICANN staff research into existing arbitral rule sets and institutions, which will provide context to our discussions on Recommendations 3 and 4. The paper is substantial, so while I would appreciate IRT members finding the time to read it prior to our first meeting, I understand that this may not be possible. If pressed for time, I recommend focusing on the IRT discussion topics under each Recommendation, as these will comprise the bulk of our dialogue. The section on Recommendation 2 also contains draft UDRP and URS updates for the IRTs review. We will walk through the material together, and having the advantage of a second 90 minute meeting there is scope to reflect on and revisit issues for further discussion. The agenda for our meetings is noted below, with the caveat that we may move faster or slower than the assumed pace. In which case we can allocate more discussion time during subsequent IRT meetings, or alternatively, relinquish some of our scheduled time in Prague: Session 1 (Meeting #5, Monday 9 June, 08:45 – 10:15 UTC): 1. Recommendations 3 & 4 continued – Arbitral Process and Rules, Implementation Pathways and Administration 3. Recommendation 5: Applicable Law for Arbitration Proceedings 4. Review of ICANN83 sessions 5. Questions As always, maximum attendance and engagement is encouraged. I also want to remind the group that while this is an IRT working session, it is also an open, public session. So while the meeting is dedicated to allowing IRT members to focus fully on progressing the work agenda, questions from non-IRT participants will be invited during the final 10 minutes of the session - but not before - in order to allow us to concentrate fully on these complex topics.
