As requested, Legal guidance on the interpretation of Section 8.8 of the
ICANN Bylaws in the case of the recent nomination for the open LACRALO ALAC position of a person who is currently serving as an ALAC Delegate to the NomCom from Latin American and the
Caribbean.
The guidance is:
For clarification, the Bylaws language that says “No person who serves on the Nominating Committee in any capacity shall be eligible for nomination by any means to any position on the Board
or any other ICANN body having one or more membership positions that the Nominating Committee is responsible for filling, until the conclusion of an ICANN annual meeting that coincides with, or is after, the conclusion of that person's service
on the Nominating Committee.” is not modified, limited, or changed because the heading says “INELIGIBILITY FOR SELECTION BY NOMINATING COMMITTEE”. Section headers do not change the plain language meaning of the words that are within each section of the Bylaws.
