Sorry, just saw this now. Apologies for the delay. My wording on legal requirements was in fact referring to GDPR and similar rules but also other legal requirements that might relate to different concerns. So
I believe your concern is already addressed. It might furthermore be challenging to recommend "balancing" legal requirements by the registries and registrars who are not in a position to question those. Please let me know if you disagree.

Recommendations:
The first recommendation should be rephrased to also take into account the legal requirements and rights of data subjects. Suggested new language:
The ICANN Board should update the Charter of its BWG-RDS to include forward-looking planning, based on a regular assessment of the RDS' fitness to meet
legal requirements and legitimate user needs as outlined in the Bylaws balanced against the legal rights of domain contacts in the privacy of their own data and legal obligations of contracted parties
to protect these rights.
