Suggested questions for Article 29 speaker
All, We will not be able to have an Article 29 Speaker on EU Privacy at this meeting. The organization is very interested in working with us, and would like to make people and resources available to us at a later meeting and throughout our process. Thanks so much, Lynn, and let’s definitely use them as part of our work! May I share them with the Article 29 Working Party in preparation for a future call? Hopefully, this eases our schedule a bit – and perhaps gives us more question/answer time with ICANN Staff (Compliance and Policy). I was feeling that time was a little too limited. All the best, and safe travels, Kathy (leaving Monday night) From: rt4-whois-bounces@icann.org [mailto:rt4-whois-bounces@icann.org] On Behalf Of lynn@goodsecurityconsulting.com Sent: Friday, January 14, 2011 8:21 PM To: rt4-whois@icann.org Subject: [Rt4-whois] Suggested questions for Article 29 speaker Dear All, Below are a few suggested questions for an Article 29 speaker regarding EU privacy. If a speaker is not available, I would be happy to adapt these questions to discussion points with the goal of developing next steps in our work regarding privacy issues that have been raised concerning the Whois database. Feedback or additional questions are certainly welcome. 1) In the recently published Strategy for Modernisation of EU Data Protection Rules issued by the Article 29 WG, one of the goals is to increase transparency for individual privacy rights. Would this goal be consistent with current ICANN policy that requires Internet domain name owners to register their contact details in a public database available to all Internet users? 2) Another goal stated in the Modernisation Strategy is to take into account the needs of police and criminal justice. This is one of our review points in the Whois policy and it would be helpful if further insight could be shared. 3) What are your views on Binding Corporate Rules for multi-national organizations with activities both inside and external to the EU? Why have so few multi-national organizations chosen this approach and do you expect any actions to encourage this option? Kind regards to all - have a good weekend! Lynn
Please feel free to go ahead and share those questions. We do have a very full agenda and I am optimistic that we will be very productive. Atlanta has been snow bound this past week but the roads are clearing today and should be back to normal tomorrow. We just do not have the snow removal equipment here because this is unusual for us. The airport did close for a time but is catching up. So hopefully they will be back on schedule by Monday night-- I'll be flying over and arriving Tues afternoon. Dear Lynn and All, What a great night last night! I truly enjoyed meeting everyone face to face! I wanted to share that in setting up the meeting with Larry Strickling a week or so ago, they asked for a few starting questions, and Emily and I shared some that had been discussed in our group. So these are in addition to Lynn’s questions. Plus there should be good time for questions on the call! As promised, let me share questions that have arisen in the Whois Review Team, for which the perspective of drafter and signatory would be most valuable. They include: - What were your goals for the Whois section of the Affirmation of Commitments? - What are your expectations for the product of the Whois Review Team; what do you expect we might report? - Can you offer insight into key terms within our AoC section that are both broad and undefined, including: o “consumer trust” and “promotes consumer trust” o “legitimate needs of law enforcement” o “applicable laws” - The Review Team has expressed some questions about the AoC as a whole which might arise in this discussion. They include questions about the interests of global Internet users, and how they might factor into our evaluation. We know this discussion will be most valuable for our work going forward!
