Just to be clear, I'm not (speaking personally) opposed to this text preceeded by, "ICANN shall have no power to act other than in accordance with, and as reasonably appropriate to achieve its Mission." I think it'd be cleaner without this, and I disagree pretty strongly with Malcolm's understanding of history, but I'm certainly not going to object to those two reasonably-clear sentences.
