The scope issue is definitely in Work Stream 1. The slide we were looking at during Milton's question was Work Party 1. Is that part of the confusion, or is Scope also in Work Party 1? That was a confusion that started in the CCWG-Board session. Work Party 1 is Community Empowerment so Scope is probably not in scope there. Sounds like Review and Redress (Work Party 2). That's a very good idea. Considering the Work Party briefs in isolation of each other creates a risk things will get missed by accident.
I would say the issue of scope needs to be in both Work Party 1 and Work Party 2: the community needs to be able to complain about an alleged breach of scope limitations without any party being particularly affected (so WP1) and individual parties need a means to be able to make the same complaint, including about community consensus policy (so also WP2).

Thomas, I'm not sure including the question of scope under "bylaws changes" gives the issue the attention it deserves. Both individuals and the community as a whole need to be able to object to something that ICANN does on the grounds that, however worthy, it's just not something that ICANN ought to be involved in. This certainly needs a mechanism, and we may indeed be able to use the same mechanism for this that would be used for other bylaws breaches. But it would very likely be advantageous to enunciate more clearly the scope if the bylaws that set it out are to be more than a general guidance for the company, and to be a standard for review that can support an objective adjudication of a complaint on this basis. At the very least, I think this is something the group should turn its mind to. Restraining ultra fires activity has been repeatedly identified as a stress test, was listed among the top level points on the mind map from Frankfurt, and really needs our considered attention Kind Regards, Malcolm

Note I did convey this was one of the areas of accountability in our Board session yesterday, and the Board broadly supports that concept. Ie that we operate within the mission etc in the bylaws. I also recognize that the community might want to better define that mission in the bylaws. I also noted that in my response to the CCWG/Board meeting today. At least I hope I did.
