This stuff can get complicated.
And it may get more complicated.
It would not surprise me at all if one of the acts of the new post-JPA ICANN is to move its incorporation outside of the US, to an environment less litigation happy and more in line with the its status as an international co-ordination body.
Except that Affirmation 8 reads "ICANN affirms its commitments to: ... (b) remain a not for profit corporation, headquartered in the United States of America ..."
...and thus, the plot thickens. :-) In a changing Internet context, in a changing world, should the AoC be a static document, or should it be an intermediate state, on the way to a new type of organisational home?
I have no doubt that things will change over time, but I suspect that on an issue that was specifically highlighted by the US Congress, ICANN will at least wait until the ink is completely dry. ;-)
