Thanks for this Carlton. The ICO asks a very good question regarding the enforcement of the regulation outside the EU. This is very relevant to the WHOIS issue. What could be done to force a a registrar or a registry outside the EU to comply with the regulation ? The answer will be interesting. Obviously, agreements like Safe Harbor have shown their limits.
