Marilyn - Apparently, I could not be heard when there was a call for other business. I won't be able to remain on the entire call as I have another meeting. Would you please ask if there are others that feel there should be a general vote on Nomination Committee representation as we do? I'm sorry if we did not object before the excomm acted, I missed that it was going to be decided by the excomm only. We are uncomfortable with the composition of BC representation on the NomComm. We would like to see a large business representative in the mix and want to see if others feel the same way. Colleagues, I would like to reiterate the proposal that I made on the BC call yesterday regarding the procedure for selecting our NomComm representatives. First however, I would like to make clear that NewsCorp is in no way questioning the integrity and competence of the candidates for the NomComm, all three would be excellent representatives. While the Bylaws appear to delegate to the Excomm a decision as to whether NomComm representatives should be appointed by the Excomm or elected by the constituency members, I would recommend that the BC, by default, adopt elections to ensure transparency and that all members' voices are heard. I would also recommend that we amend the Bylaws to require elections for BC Nomcomm representatives. I have been contacted by some of my members (ICC) that are also BC members regarding this matter. I recognize that this is a very important procedural matter that could have a profound impact on the BC's representation within the GNSO, Board and other positions' selection processes. I feel that without a more formal decision from my broader membership (ICC membership) I cannot weigh in formally on this matter. With this in mind, I feel that I should recuse myself from offering any personal thoughts on this matter also given that my partner is on the ICANN Board and I would like to avoid any appearance of conflict for myself and to avoid any possible negative implications for the BC itself. Ayesha, As an ICC member I understand your constraints in not being able to offer a position for your organization. I also want to thank you for your transparency. Your professionalism in highlighting your personal conflict publicly and recusing yourself from a debate regarding the Nomcomm selection process is much appreciated and an important reminder to all of us that we need to avoid any conflicts in our activities within the BC. Public disclosure of such conflicts ensures the credibility of our processes and the BC itself. Dear Ayesha and David, I agree that we in the BC should maintain the highest standard of both transparency and accountability and avoid both actual and perceived conflicts of interest. As a member of the Excom which 'selected' (and did not elect) Nomcom appointees it would be appropriate and proper (due to the selection) for me to declare that I have no existing interest in appointments to me made by the Nomcom and if I am approached by this round of the Nomcom (where members selected and not elected by the Excom are present) I undertake to decline any such appointments. I am sure that other members of the Excom will also come forward in like manner. I'm sorry if we did not object before the excomm acted, I missed that it was going to be decided by the excomm only.
We are uncomfortable with the composition of BC representation on the NomComm. We would like to see a large business representative in the mix and want to see if others feel the same way.

I have no conflict of interest in the selection of the BC appointees to the NC. Planning for interaction with the NomComm Chair and Chair Elect ICANN has announced the Chair and Chair Elect, and I invite members to review those announcements on the ICANN website. Interaction with the BC: The Nominating Committee, with the new Chair and Chair Elect, and other participants, will join the BC for a 30 minute slot. The Chair will explain that the NC maintains strict confidentiality of SOIs received, and even those who are past members are bound by a strict confidentiality guideline. Please review the bylaw information about the NC roleand responsibilities. To maximize your contribution during this discussion, I would suggest that you review some of the recent reports of the NomComm in addition. You can find those by doing a search on the website. We are finalizing the slot with the NC and will do our best to organize it on Tuesday or Wednesday in our scheduled time slots. Marilyn Cade, BC Chair

Elisa, I guess my question was have we resolved the issue of who are the BC's NomComm representatives? I couldn't find a definitive answer in the mail threads and consequently it appears as an open item to me. I take your answer to mean that the current se of appointees is set and the BC will not be addressing the issue further at this time. However, it remains unclear to me how we, the BC arrived at this decision. Perhaps it is minuted and I am remiss in not reading the minutes. Sorry to be a bother on this but I saw an important process question raised, a considerable amount of mail related to that question, and I'm not certain of the resolution or the manner of that resolution. I apologize if I'm being difficult. Best, Bill On Oct 13, 2012, at 9:42 AM, Elisa Cooper <Elisa.Cooper@markmonitor.com> wrote:
Bill,
I believe that we agreed to modify the Charter to mandate a vote on future NomComm appointees.
Not sure what the next steps are though?
Best, Elisa

Likewise.
What is the status of this issue? I have been more than a little busy with the ITU and other non-ICANN Internet Governance issues and haven't been able to keep up on all mail lists.

Colleagues,
I would like to reiterate the proposal that I made on the BC call yesterday regarding the procedure for selecting our NomComm representatives.
Thanks, David

Agree. Would like to know who was the third nominee and why ExComm took it upon itself to make this decision without input from Members.
Thanks, Mike

Apparently, I could not be heard when there was a call for other business. I won't be able to remain on the entire call as I have another meeting. Would you please ask if there are others that feel there should be a general vote on Nomination Committee representation as we
do?
I'm sorry if we did not object before the excomm acted, I missed that it was going to be decided by the excomm only.
We are uncomfortable with the composition of BC representation on the NomComm. We would like to see a large business representative in the mix and want to see if others feel the same way.
Thank you - Fred
