Dear Colleagues, As per our December 23rd discussion regarding our feedback to the CCWG 3rd proposal, please see the attached for our proposed statement. For your convenience I have also pasted it below. I would like to send this to the CCWG on Monday. If there are any suggestions or concerns, please provide your feedback asap. In addition, the ccNSO Council also notes that based on comments and input from ccTLDs and Regional Organisations, the 3rd CCWG Accountability Proposal may need additional refinement to take into account concerns raised so as to increase the likelihood of adoption of the Final Proposal by all. Greetings Byron, I concur with the first two paragraphs. I do, however, have some issues with the third paragraph that I want to put on the record. First, the phrase "Taking into account the support for the substantial elements in the 3rd Proposal by a majority of the ccNSO appointed members of the CCWG" substitutes the concept of "voting" for "consensus" --yes, it's true that 4 out of 5 of the ccNSO Council appointed members to the CCWG appear to support the CCWG Accountably Proposal #3 (30 November 2015), but the fifth member does not. Under a "consensus" model (which I've been assuming we've been operating under with all things ICANN-wise these last 14+ years), this is hardly "consensus" for support for the V3 proposal.) I thus question the use of the phrase "a majority of the ccNSO appointed members of the CCWG". How does 80% constitute "consensus"? I think a more nuanced phrasing would be appropriate. Second, I question the reference to the ccNSO Community consultation that we undertook in Dublin given that what transpired during the course of the Dublin meeting evolved over the course of that meeting into a very different beast post-Dublin, first with the shift of models during the course of the latter days of the Dublin meeting, and second, with the firming up of the details that led to the CCWG Accountability proposal of 30 November. I cannot subscribe to the fact that although the model shift was proposed and discussed in Dublin, it is in anyway realistic to assume that ccNSO members actually absorbed the details of the model shift in our F2F meeting in Dublin, let alone our non ccNSO ccTLD colleagues who do not follow our activities pro-actively, absorbed it. And at the end of the day, we need to take into consideration, as much as we can, our non-participatory colleagues in our decision making. I concur with the rest of the proposed statement beginning with "However, the ccNSO Council strongly recommends that the CCWG-Accountability implement." I humbly request that you and Bart revise the proposed statement to reflect the concerns that I have expressed regarding its current content. I appreciate the diplomacy of the 'direction of travel' quote, but I am mildly concerned about words 'ccNSO Council supports'. I'm having a little trouble understanding Council's role (as forming part of ICANN) in approving proposals for constitutional change, and would appreciate some guidance as to what our powers are under the By-laws. I regret that the conditions did not allow me to fully participate in the Council meeting, so maybe this was touched on already? I'm also a bit concerned about the admission that our reps did not reach consensus. Could that be toned down? Surely it would be preferable Council might ask our 5 reps to get in a corner and hammer out an agreement before we support (even 'provisionally') this 'cat in a bag'? However, if we agree to hear from the dissenting CCWG member, then I think that we should hear from all ccNSO appointed CCWG members - in order to ensure balance and a full range of information and views are provided to the Council. I do note however that we have heard from Matieu already (presumably echoing the views of Jordan, Giovanni, and Roelof). But by all means let's hear from them all. I would be especially interested in their thoughts regarding the Board's comments, as well as why they do not apparently share Eberhard's concerns. Dear Chair Should Council wish to send this, may I please ask that this text be set out formally as a Resolution and approved by an email (or other) vote of Council so that I may place on the record that I am not, at this time, in favour of approving the text as proposed by Byron, below. Despite the very inconvenient scheduling of the Council meeting within our Christmas holidays, I did my best to attend and participate, literally whilst travelling amont the Christmast traffic. Notwithistanding this, I do not feel that the "fluid situation" such as you described at the beginning of the call warrants such words of endorsement, even when they are qualified as "provisional". My underanding of the statemet we were to issue was one of thanks and encouragement, NOT agreement. Additionally, as requested, can I again ask that someone please explain where, in the By-Laws, the Council has the role to "support" policy matters such as ICANN constitutional change for ccTLD managers. I see from Section 8 of the CCNSO Article that our role is

The role of the ccNSO Council is to administer and coordinate the affairs of the ccNSO (including coordinating meetings, including an annual meeting, of ccNSO members as described in Section 4(6) of this Article) and to manage the development of policy recommendations in accordance with Section 6 of this Article. The ccNSO Council shall also undertake such other roles as the members of the ccNSO shall decide from time to time.
I do not believe this does not allow us -- acting as a body -- to "support" policy recommendations, such as recommendations for constitutional change. That, I would submit, is reserved to the Members as a whole acting in accordance with Section 6 and that issuing this statement as such, would be outside the scope of Council as set out in the By Laws. Draft Statement on the 3^rd Draft Proposal of the Cross Community Working Group Accountability (CCWG Accountability)
The ccNSO Council fully appreciates the exemplary, long and intensive efforts the CCWG-Accountability has undertaken to deliver the 3^rd Proposal to the ccNSO as one of the chartering organizations and wholeheartedly thanks all members and participants of the CWG-Accountability for their perseverance and hard work.
The ccNSO Council wants to draw the attention to the comments made by the CWG-Stewardship, and its assessment that the 3^rd Proposal does not fully meetthe conditions and requirements of the CWG-Stewardship final transition proposal.
Taking into account the support for the substantial elements in the 3^rd Proposal by a majority of the ccNSO appointed members of the CCWG, and factoring in the guidance from the Dublin ccNSO meeting as well as the public comments from the ccTLDs and Regional Organisations on the 3^rd Proposal, the ccNSO Council provisionally supports the direction of travel of the 3rd Proposal. However, the ccNSO Council stronglyrecommends that the CCWG-Accountability implement the changes requested by the CWG-Stewardship. In addition,the ccNSO Council also notes that based on comments and input from ccTLDs and Regional Organisations, the 3^rd CCWG Accountability Proposal may need additional refinement to take into account concerns raised so as to increase the likelihood of adoption of the Final Proposal by all. Hi Nigel, As per the agreement of our Council meeting of December 23rd: 1) No formal resolution was to be required 2) The ccNSO Council would provide input to the CCWG, which would request greater clarity on key issues as well as adherence to the requirements of the CWG. Further, that the ccNSO was generally supportive of the "direction of travel". 3) This input was to be summarized by the Chair and shared with Council before transmission to the CCWG. We all agreed on this. This is what has been done, subject to the change suggested by Stephen, which has been incorporated into the statement. Section 6 refers to the PDP process and does not have bearing on the Council providing feedback to this ongoing process. There are two additional points I would like to make:
1)I did not include any reference to the ICANN Board comments. It is not our place to add to or reduce the weight of those comments at this time. Further, there is no agreement by the ccTLD community on the Board comments one way or another as this was not the intent of this statement. For the purposes of this statement I am not prepared to bring the Board comments into the ccNSO Council response to the CCWG.
2)The 4/5 ccTLD CCWG members who supported the Proposal and the 1/5 who did not all submitted written feedback to the ccTLD community (and us). Further, they all spoke, at some length, in Dublin so we know where they stand at this time. Subsequent to the refined 4^th Proposal (assuming there is one) we can invite our CCWG members to speak to the Council, logistics permitting, or provide a written submission.

I agree with the 'will' amendment and support the text from Byron subject to this change.
However, if we agree to hear from the dissenting CCWG member, then I think that we should hear from all ccNSO appointed CCWG members - in order to ensure balance and a full range of information and views are provided to the Council.
