Dear Stephen As you know we recently started our internal discussions on possible roles and responsibilities of the ccNSO and ICANN with respect to implementation of ccNSO policies. To kick-off that discussion with ICANN we agreed at our February meeting to send a letter to Theresa Swinehart and include it as a topic in our conversation with members of the Board. Theresa replied to our invitation, and relevant staff - senior experts in GNSO PDP policy/implementation processes - will attend the governance session to take the next steps. Of course you are entitled to your own opinion, however when sharing it on the list I want to remind you that it is being archived and hence public. I believe that in this case your opinion is not based on facts, inappropriate and counter-productive. It not only affects us, but also our staff. Going forward I would appreciate it if you could restrain yourself in general, and with respect to this topic realize that we are just starting our dialogue internally, and with ICANN. It is insulting to the ccNSO and the ccTLD Community writ large. Full-stop.

I am serious about this: IT IS INSULTING. She should pitch up. She must pitch up. Again, full-stop.

By her not pitching up, she is basically saying that she and the other senior levels of ICANN Org management do not give a rat’s ass about the ccNSO or the ccTLDs in general.

Yet it is the ccTLDs, via the ccNSO, that give ICANN it’s international legitimacy and keep it from being seen globally as just a trade organisation for the gTLDs.

She must be held accountable and appear.

As you will recall the ccNSO policy on retirement of ccTLDs was recently - September 2022 - adopted by the Board and the CEO or his designee was directed to implement the recommended policy. Following the adoption, the ccNSO is exploring how to structure the interaction between the ccNSO & ICANN (org and the Board) to ensure predictability and clarity of roles with respect to the implementation of policies developed by the ccNSO.

It is our expectation that clarity around this topic will become more important in 2023, as the ccNSO is likely to conclude both the second part of the third ccNSO PDP on review mechanisms and the PDP on the (de-)selection of IDNccTLD strings during this period.

It is our understanding that with respect to implementation of GNSO consensus policies, the GNSO has developed a set of principles and guidelines that define the interaction between the GNSO and ICANN. We also understand that ICANN’s GDS/GDD has developed a Consensus Policy Implementation Framework (CPIF), which is designed to support predictability, accountability, transparency, and efficiency in the Consensus Policy implementation process.

The ccNSO Council believes that the ccNSO would benefit from developing an equivalent set of principles, guidelines and, if applicable, a framework to cover its interaction with ICANN org and the Board with respect to the implementation of policies developed by the ccNSO. This topic will be introduced to the broader ccTLD community at the ccNSO Governance session [Tuesday 14 March 2023, block 4]. We kindly invite you, or someone you designate, to attend this session. It is also a topic the ccNSO will propose as part of the dialogue with the ccTLD related Board members [Wednesday 15 march 2023, block 5].
